There is hereby created the Construction Division within the\n\nDepartment of Corrections. The purpose of the division shall be to\n\nprovide inmate construction crews for construction projects of the\n\nDepartment of Corrections.\n\nB. The Director of the Department of Corrections shall adopt\n\nand promulgate such rules as may be necessary to carry out the\n\nduties of the Construction Division and shall appoint a Director of\n\nthe division who shall administer the activities of the division.\n\nC. 1. An inmate working for the Construction Division of the\n\nDepartment of Corrections shall be subject to all rules established\n\nfor inmate work by the State Board of Corrections and subject to all\n\nstatutes governing the operation of the Construction Division of the\n\nDepartment of Corrections.\n\n2. Inmates working for the Construction Division are not state\n\nemployees, and are specifically forbidden from organizing into\n\nunions or other associations in connection with their work or from\n\nengaging in any strike, work stoppage, slowdown or collective\n\nbargaining process. This prohibition applies to any inmates forming\n\na union local or similar organization at any Construction Division\n\nproject or location; provided, however, it shall not prohibit any\n\ninmate from otherwise achieving or retaining status as a union\n\nmember.\n\n3. The claims of the state against an inmate to cover the costs\n\nof incarceration of an inmate shall be prior to the unsecured claims\n\nof any creditor.\n\n4. The authorization for an inmate to work for the Construction\n\nDivision is a privilege granted to the inmate by the state which may\n\nbe revoked by the Director of the Department of Corrections.\n\n5.
