Stat. tit. 57, § 57-509.7","heading":"Sex-segregated restrooms, changing rooms, and sleeping","body":"quarters — Cause of action.\n\nA. For purposes of this section:\n\n1. “Changing room” means a room or area in which a person may\n\nbe in a state of undress while in the presence of others, including\n\na locker room or shower room;\n\n2. “Covered entity” means an institution or facility operated\n\nby the Department of Corrections or contracted with the Department\n\nof Corrections as provided in Section 502 of Title 57 of the\n\nOklahoma Statutes;\n\n3. “Multi-occupancy” means a space that is designed to be\n\nutilized by multiple persons simultaneously;\n\n4. “Restroom” means a room that includes one or more toilets or\n\nurinals; and\n\n5. “Sleeping quarters” means a room that contains a bed and in\n\nwhich more than one individual is housed overnight.\n\nB. 1. A covered entity shall designate each multi-occupancy\n\nrestroom, changing room, and sleeping quarters for the exclusive use\n\nof either females or males.\n\n2. Every restroom, changing room, or sleeping quarters within a\n\ncovered entity that is designated for use by females or males shall\n\nonly be used by members of the designated sex. No individual shall\n\nenter a restroom, changing room, or sleeping quarters that is\n\ndesignated for members of the opposite sex.\n\n3. A covered entity shall take reasonable steps to provide\n\nindividuals with privacy from members of the opposite sex in\n\nrestrooms, changing rooms, and sleeping quarters.\n\n4. This section shall not apply to an individual who enters a\n\nrestroom, changing room, or sleeping quarters designated for members\n\nof the opposite sex in any of the following circumstances:\n\na. performance of custodial services or maintenance,\n\nb. rendering of medical or law enforcement assistance, or\n\nc. provision of services or aid during a natural disaster\n\nor declared emergency, or when necessary to prevent a\n\nserious threat to order and safety.\n\n5. Nothing in this section shall be construed to prohibit a\n\ncovered entity from:\n\na. adopting policies necessary to accommodate persons\n\nprotected under the Americans with Disabilities Act of\n\n1990 or elderly persons in need of aid or assistance,\n\nb. establishing single-occupancy restrooms, changing\n\nrooms, or sleeping quarters, or\n\nc. redesignating a multi-occupancy restroom, changing\n\nroom, or sleeping quarters designated for exclusive\n\nuse by members of one sex to that of members of the\n\nopposite sex.\n\n6. The Department of Corrections shall promulgate rules to\n\nadminister the provisions of this section.\n\nC. 1. Any individual who accesses a restroom or changing room\n\nfor use by members of his or her sex and encounters a person of the\n\nopposite sex in such restroom or changing room has a private cause\n\nof action for declaratory and injunctive relief against the covered\n\nentity that:\n\na. provided permission to the person of the opposite sex\n\nto use such restroom or changing room, or\n\nb. failed to take reasonable steps to prohibit access of\n\nthe restroom or changing room to the person of the\n\nopposite sex.\n\n2. Any individual who is required by the covered entity to\n\nshare sleeping quarters with a person of the opposite sex has a\n\nprivate cause of action for declaratory and injunctive relief\n\nagainst the covered entity.\n\n3. Any civil action brought against a covered entity pursuant\n\nto this section shall be initiated within two (2) years after the\n\nviolation occurred.
