Stat. tit. 57, § 57-51.1","heading":"Persons with Acquired Immune Deficiency Syndrome (AIDS) -","body":"Violation of § 1192.1 of Title 21 - Transfer to Department of\n\nCorrections for extended medical care.\n\nAny person who has the Acquired Immune Deficiency Syndrome\n\n(AIDS) disease who is confined in the county jail in violation of\n\nSection 1192.1 of Title 21 of the Oklahoma Statutes, whether\n\nconvicted or pending trial, may be transferred to the Department of\n\nCorrections for extended medical care for the duration of the\n\nsentence imposed or pending trial. At the request of the medical\n\nofficer, physician or surgeon employed by said jail, the county\n\nsheriff shall make application to the Department of Corrections for\n\na transfer of the person and the Department of Corrections may\n\naccept the person under the following conditions:\n\n1. The person's right to a speedy trial is not delayed by the\n\ntransfer to a state facility;\n\n2. The person's right to confer with legal counsel is not\n\nrestricted by the transfer to a state facility;\n\n3. The county agrees to a mutual exchange of inmates from the\n\nDepartment of Corrections for the medical care and custody of the\n\nperson to be transferred;\n\n4. The medical care or custody of the person is necessary to\n\npreserve the health and safety of the public, the inmates of the\n\ncounty jail or the person being transferred;\n\n5. The person to be transferred may be adequately treated in\n\nthe state facility; and\n\n6.
