Stat. tit. 57, § 57-510.1","heading":"Time away from correctional facility for committed","body":"offender - Purposes.\n\nA. The Department of Corrections may extend the limits of the\n\nplace of confinement of a committed offender at any of the state\n\ncorrectional facilities by authorizing such committed offender under\n\nspecial conditions to be away from such correctional facility but\n\nwithin the state. Such authority may be granted for any of the\n\nfollowing purposes:\n\n1. To attend the funeral of a relative;\n\n2. To visit a critically ill relative;\n\n3. To obtain medical, psychiatric, sociological or social\n\nservices in the community; or\n\n4. To participate in public works projects.\n\nB. Except as provided in subsection C of this section, the\n\nDepartment of Corrections may extend the limits of the place of\n\nconfinement of a committed offender at any of the state correctional\n\nfacilities by granting the offender a pass authorizing the committed\n\noffender to be away from the correctional facility, but within the\n\nstate, for any of the following purposes:\n\n1. To contact prospective employers;\n\n2. To secure a suitable residence for use upon release on\n\nparole or discharge;\n\n3. To participate in work, educational and training programs in\n\nthe community; or\n\n4. For any other reasons consistent with the reintegration of a\n\ncommitted offender into the community, if authorized by law.\n\nC. Offenders whose controlling, concurrent, or consecutive\n\nsentence is for a sex or incest related offense or drug trafficking\n\noffense or who have a prior conviction for a sex or incest offense\n\nor drug trafficking offense shall not be eligible for passes\n\nauthorized by subsection B of this section at minimum security\n\nfacilities. Offenders assigned to a community treatment center or a\n\ncommunity security facility whose controlling, concurrent, or\n\nconsecutive sentence is for a sex or incest related offense or drug\n\ntrafficking offense or who have a prior conviction for a sex or\n\nincest offense or drug trafficking offense shall not be eligible for\n\npasses authorized by subsection B of this section until they are\n\nwithin eleven (11) months of current release date or on a parole\n\nstipulation for work release of one hundred eighty (180) days or\n\nless, except that offenders with a conviction for forcible sodomy,\n\nrape in the first degree, rape by instrumentation, or lewd or\n\nindecent act with a child shall not be eligible for passes until\n\nthey are within six (6) months of current release date or in the\n\nfinal ninety (90) days of a parole stipulation.\n\nD. For the purpose of this section, \"relative\" means the\n\noffender's father, mother, child, stepchild or adopted child,\n\nbrother, sister, current spouse, or grandparents, and upon\n\nacceptable documentation, any person who served a parental capacity.\n\nAny approved visit may be considered a cost of incarceration\n\nreimbursable to the Department.\n\nE. A person away from a correctional facility, pursuant to this\n\nsection, and who is classified in medium or higher security shall be\n\naccompanied by an officer or other employee of the Department.\n\nF. A committed offender is, during his absence, to be\n\nconsidered as in the custody of the correctional facility and the\n\ntime of such absence is to be considered as part of the term of\n\nsentence. Failure to return to the facility shall be deemed an\n\nescape and subject to such penalty as provided by law.\n\nG.
