Stat. tit. 57, § 57-510.8","heading":"Priority of placement - Refusal to participate - Waiver","body":"of educational requirements.\n\nA. The Department of Corrections shall implement procedures to\n\nensure that priority for placement of eligible inmates in education\n\nprograms be given to inmates lacking basic literacy skills and to\n\ninmates closest to their projected release dates.\n\nB. Any incarcerated inmate that refuses to participate in\n\nrecommended education programs shall be ineligible for earned\n\ncredits as provided in Section 138.1 of this title and shall\n\njeopardize the eligibility of the inmate for parole or participation\n\nin the Preparole Conditional Supervision Program.\n\nC. Any eligible inmate who has not achieved the educational\n\nproficiency level established in Section 510.7 of this title, prior\n\nto the date of eligibility for parole or preparole conditional\n\nsupervision, shall be required by the Pardon and Parole Board to\n\nparticipate in education programs approved by the Board to achieve\n\nthe proficiency level or, at the discretion of the Board, to obtain\n\na high school equivalency diploma as a condition of parole or\n\npreparole conditional supervision.
