There is hereby created in the State Treasury a revolving\n\nfund for the Office of Management and Enterprise Services to be\n\ndesignated the \"Criminal Justice Pay for Success Revolving Fund\".\n\nThe fund shall be a continuing fund, not subject to fiscal year\n\nlimitations, and shall consist of all monies appropriated to the\n\nCriminal Justice Pay for Success Revolving Fund and monies which may\n\notherwise be available to the Office of Management and Enterprise\n\nServices for use as provided for in this section.\n\nB. All monies appropriated to the fund shall be budgeted and\n\nexpended by the Office of Management and Enterprise Services for the\n\npurpose of funding contracts for those criminal justice programs\n\nthat have outcomes associated with reducing public sector costs.\n\nPursuant to contract, the Office of Management and Enterprise\n\nServices shall provide payment to social service providers for the\n\ndelivery of predefined criminal justice outcomes. The Office of\n\nManagement and Enterprise Services shall approve only those\n\ncontracts that meet the following requirements:\n\n1. The social service provider can provide not less than Two\n\nMillion Dollars ($2,000,000.00) in capital to fund the delivery of\n\nservices necessary to achieve the predefined criminal justice\n\noutcomes;\n\n2. The social service provider can provide verifiable evidence\n\nof successful completion rates of persons who participated in the\n\ndiversion or reentry program offered by the service provider; and\n\n3. Persons participating in the diversion or reentry programs\n\noffered by the service provider are not under the custody or control\n\nof the Department of Corrections.\n\nC. Expenditures from the fund shall be made upon verification\n\nby the Office of Management and Enterprise Services that successful\n\ncompletion of the diversion or reentry program was achieved by the\n\nparticipant pursuant to contract.
