Whenever a person is convicted of a felony and is sentenced\n\nto imprisonment that is not to be served in a county jail, the\n\nperson shall be committed to the custody of the Department of\n\nCorrections and shall be classified and assigned to a correctional\n\nfacility or program designated by the Department and authorized by\n\nlaw.\n\nB. It is the intent of the Legislature that inmates in the\n\ncustody of the Department of Corrections, prior to leaving the\n\ncustody of the Department, be reintegrated into society through the\n\nuse of work release programs, work centers, community corrections\n\ncenters, intermediate sanctions facilities, accredited halfway\n\nhouses and transitional living centers, subject to the availability\n\nof space and funding.\n\nC. All persons who have nonassaultive institutional records and\n\nwho are convicted of only previous and current nonviolent offenses\n\nand have a nonviolent juvenile record and are sentenced to the\n\ncustody of the Department of Corrections shall be processed for\n\nassignment to a work release program, a work center, a community\n\ncorrections center, an intermediate sanctions facility, an\n\naccredited halfway house, a transitional living facility, or any\n\ncombination of such placements not less than two hundred ten (210)\n\ncalendar days immediately prior to release from the custody of the\n\nDepartment of Corrections, unless the offender is currently\n\nparticipating in another approved program based upon the offender’s\n\nneeds assessment. Other persons may be processed for assignment\n\naccording to the offender’s needs and security classification not\n\nmore than one hundred eighty (180) days prior to release from the\n\ncustody of the Department. This assignment shall be for the purpose\n\nof assisting the person in obtaining gainful employment, receiving\n\nreintegration skills, and locating a suitable post-release\n\nresidence. For purposes of this subsection, assistance in obtaining\n\nemployment, receiving reintegration skills, and a post-release\n\nresidence shall be part of the function of the placement and shall\n\nnot be construed to require or authorize any financial assistance or\n\nexpenditure of state funds to any inmate or to any contract provider\n\nfor additional program services to an individual inmate.\n\nD. The provisions of subsections B and C of this section shall\n\nnot be applicable to inmates, as determined on an individual basis\n\nby the Department of Corrections, who otherwise constitute a serious\n\nor immediate risk to public health and safety.\n\nE. Nothing in this section shall require a county jail to\n\nprovide any services that are not currently being provided.\n\nF. Not later than February 1st of each year beginning February\n\n1, 2011, the Director of the Department of Corrections shall post on\n\nthe Department's website and transmit to the President Pro Tempore\n\nof the Senate, the Speaker of the House of Representatives, and the\n\nGovernor, a report on the progress of the Department in meeting the\n\ngoals and intent of subsections B and C of this section. Such\n\nreport shall, at a minimum, include the following information:\n\n1. A listing of all facilities owned, operated, and/or\n\ncontracted to the Department by security level together with the\n\nnumber of inmates released from each facility during the preceding\n\ncalendar year;\n\n2. A total of the number of inmates released from physical\n\ncustody during the preceding calendar year;\n\n3. A total of the number of inmates employed by private\n\nemployers prior to the inmate's release from physical custody; and\n\n4. A total of the number of inmates exiting the Department's\n\nsystem who have spent less than one hundred eighty (180) calendar\n\ndays in a halfway house.\n\nThe report shall be in such form and contain such other information\nthe number of inmates employed by private\n\nemployers prior to the inmate's release from physical custody; and\n\n4.
