There is hereby created in the State Treasury an Industries\n\nRevolving Fund for the Department of Corrections.\n\nB. The revolving fund shall consist of earnings derived from\n\nprison industries operated by the Department of Corrections and from\n\nthat portion of the prisoner's income apportioned and paid into the\n\nprison system to recover the cost of incarceration of the prisoners\n\nas provided by law. Funds derived from prisoner wages shall be\n\nmaintained and accounted for separately in this fund. The\n\nIndustries Revolving Fund shall be a continuing fund, not subject to\n\nfiscal year limitations, and shall be under the control and\n\nmanagement of the State Board of Corrections.\n\nC. Expenditures from the Industries Revolving Fund shall be\n\nbudgeted and expended pursuant to the laws of the state and the\n\nstatutes relating to public finance and to the institution. The\n\nfund may be used to purchase, maintain and repair machinery, to\n\npurchase materials and supplies for the prison industries and to\n\ndefray any other expenses necessary to operation of the industries,\n\nwith first priority being given to repairs, replacement and\n\nmodernization of industrial or agricultural machinery or equipment.\n\nThese funds may also be used to support the overall operation of the\n\nDepartment of Corrections subject to approval of the Director of the\n\nDepartment of Corrections. Expenditures from the fund derived from\n\nprisoner's income may be used for the maintenance of prisoners in\n\nprison institutions and all expenses related thereto under such\n\nrules as may be established by the State Board of Corrections.\n\nWarrants for expenditures from the Industries Revolving Fund shall\n\nbe based on claims signed by an authorized employee or employees of\n\nthe Department, and approved for payment by the Director of the\n\nOffice of Management and Enterprise Services. The Department shall\n\nmaintain a separate accounting of receipts and expenditures for each\n\nindustry for periodic review by the Legislature. The fund may not\n\nbe used to employ personnel in excess of those authorized by\n\nlegislative action.\n\nD. All funds in the Department of Corrections' Industries\n\nRevolving Funds not encumbered or obligated upon the operative date\n\nof this section shall be transferred to a single Industries\n\nRevolving Fund of the Department of Corrections.\n\nE. The Administrator of Industrial Production will determine\n\nthe prices of all goods produced through the state prison\n\nindustries, and the Administrator of Agri-Services will determine\n\nthe prices of all goods produced by Agri-Service units. These\n\nprices will be filed with the Budget Office.\n\nWhen industrial or agricultural items or products are furnished\n\nto the institutions of the Department, or sold to other governmental\n\nagencies, payment therefor shall be made within thirty (30) days for\n\ndeposit in the revolving account to be used in purchasing expendable\n\nitems, raw materials or other items needed to produce additional\n\nsuch products or items, and for such other purposes as are\n\nauthorized by law. The Administrator of Industrial Production or\n\nAdministrator of Agri-Services may establish higher prices for sale\n\nof products to governmental agencies, according to the current\n\nmarket value of each product.\n\nF. The Department of Corrections is authorized to pay inmates\n\nfor productive work in accordance with policies set by the State\n\nBoard of Corrections. The State Board of Corrections shall certify\n\nthe positions to be paid and the rate of pay in accordance with the\n\nresponsibilities and skills required for the position. The\n\nDepartment of Corrections shall develop policies for payment of\n\ninmates in the Industries Program that promote productivity as well\n\nas compensate for responsibilities and skills. The Department shall\n\nfile such policy statements with the Chairs of the appropriate\n\ncommittees of both the Senate and the House of Representatives as\nth the\n\nresponsibilities and skills required for the position. The\n\nDepartment of Corrections shall develop policies for payment of\n\ninmates in the Industries Program that promote productivity as well\n\nas compensate for responsibilities and skills. The Department shall\n\nfile such policy statements with the Chairs of the appropriate\n\ncommittees of both the Senate and the House of Representatives as\n\ndesignated by the President Pro Tempore of the Senate and the\n\nSpeaker of the House of Representatives.
