The State Board of Corrections shall have the following\n\npowers and duties with respect to the operation of prison\n\nindustries, the Construction Division of the Department of\n\nCorrections, and administration of inmate trust funds:\n\n1. The power to make leases or other contracts consistent with\n\nthe operation of prison industries, and to set aside land or\n\nfacilities for the use of such industry;\n\n2. The power to establish conditions for expenditures by the\n\nDepartment of Corrections from the Industries Revolving Fund;\n\n3. The power to negotiate wages and working conditions on\n\nbehalf of prisoners working in prison industries or prisoners\n\nworking in the Construction Division. Pay grades for the\n\nConstruction Division “on-the-job training” inmate crews shall be as\n\nfollows:\n\na. Pay Grade “A” - Inmate Worker,\n\nb. Pay Grade “B” - Inmate Worker,\n\nc. Pay Grade “C” - Apprentice, and\n\nd. Pay Grade “D” - Skilled Craft;\n\n4. The power to collect wages and other receipted funds on\n\nbehalf of the inmate, to apportion inmate wages and funds in\n\naccordance with the law; and the duty to preserve those wages and\n\nfunds reserved for the inmate in an account for his or her benefit,\n\nand to establish procedures by which the inmate can draw funds from\n\nthis account under the conditions and limitations and for the\n\npurposes allowed by law;\n\n5. The duty to establish the percentages of such wages which\n\nshall be available for apportionment to inmate mandatory savings; to\n\nthe inmate for his or her personal use; to the lawful dependents of\n\nthe inmate, if any; to the victim of the inmate’s crime; for payment\n\nof creditors; for payment of costs and expenses for criminal actions\n\nagainst such inmate; and to the Department of Corrections for costs\n\nof incarceration. Provided, that not less than twenty percent (20%)\n\nof such wages shall be placed in an account, and shall be payable to\n\nthe prisoner upon his or her discharge; however, inmates with a\n\nsentence of life or life without the possibility of parole shall be\n\nexempt from this provision. Funds from this account may be used by\n\nthe inmate for fees or costs in filing a civil or criminal action as\n\ndefined in Section 151 et seq. of Title 28 of the Oklahoma Statutes\n\nor for federal action pursuant to Section 1911 et seq. of Title 28\n\nof the United States Code, 28 U.S.C., Section 1911 et seq.;\n\n6. The power to invest funds held by the Department of\n\nCorrections on behalf of each inmate in an interest-bearing account\n\nwith the interest accruing and payable to the Crime Victims\n\nCompensation Revolving Fund, as provided in Section 142.17 of Title\n\n21 of the Oklahoma Statutes. The interest from each inmate’s\n\nsavings account shall be payable to the Crime Victims Compensation\n\nRevolving Fund, at such intervals as may be determined by the Board,\n\nin addition to any other payments to such fund required by the\n\ninmate’s sentence or otherwise by law. An inmate shall not have the\n\nright, use, or control of any interest derived from any funds placed\n\nin a mandatory savings account;\n\n7. The power to invest funds held by the Department of\n\nCorrections on behalf of each inmate in a commingled offender\n\ninterest-bearing account held by the Office of the State Treasurer.\n\nThe State Treasurer shall post interest to this account monthly.\n\nThe Department of Corrections, at such intervals as may be\n\ndetermined by the Board, will credit interest to the inmate based on\n\nthe pro rata account balance of the inmate. Deposits into the\n\ninmate interest-bearing account will only be allowed when the trust\n\nfund draw account of the inmate has a balance in excess of One\n\nHundred Dollars ($100.00). Inmate mandatory savings account\n\nbalances will not be used to determine the eligibility of the inmate\n\nto participate in the interest-bearing savings account. Inmates who\n\nparticipate in the interest-bearing account will only be allowed to\ninmate interest-bearing account will only be allowed when the trust\n\nfund draw account of the inmate has a balance in excess of One\n\nHundred Dollars ($100.00). Inmate mandatory savings account\n\nbalances will not be used to determine the eligibility of the inmate\n\nto participate in the interest-bearing savings account. Inmates who\n\nparticipate in the interest-bearing account will only be allowed to\n\ntransfer funds from their interest-bearing account to their draw\n\naccount once every ninety (90) days. All inmate transfers from the\n\ninterest-bearing account of the inmate to the draw account of the\n\ninmate must be approved by appropriate Department staff prior to\n\ntransfer. All transfers of funds from an inmate interest-bearing\n\naccount to external recipients must be reviewed and approved by\n\nappropriate Department staff prior to transfer. The Department will\n\ndefine in policy those rules and procedures that govern inmate\n\ninterest-bearing account deposits and funds transfers; and\n\n8. The power to invest canteen system, offender restitution,\n\nand other offender-related collections by the Department of\n\nCorrections in a commingled interest-bearing account held by the\n\nOffice of the State Treasurer and invested as prescribed by Section\n\n89.2 of Title 62 of the Oklahoma Statutes. The State Treasurer\n\nshall post interest to this account monthly. By the fifteenth day\n\nof each month, the proportionate share of the interest from the\n\ncanteen system, offender restitution, and other offender-related\n\ncollections, excluding that portion of the interest payable to the\n\nCrime Victims Compensation Revolving Fund and any interest payable\n\nto inmates for the inmate interest-bearing account, shall be\n\nremitted to the State Treasurer from the Department of Corrections\n\nfor deposit into the General Revenue Fund.\n\nB. The State Board of Corrections shall cause to be placed in\n\nan account income from the inmate’s employment and any other income\n\nor benefits accruing to or payable to and for the benefit of the\n\ninmate, including any workers’ compensation or Social Security\n\nbenefits.\n\n1. From this account the State Board of Corrections may charge\n\nfor costs of incarceration any inmate working in private prison\n\nindustries or any other inmate for costs of incarceration not to\n\nexceed fifty percent (50%) of any deposits made to such account,\n\nunless such deposits were from a workers’ compensation benefit.\n\n2. From this account, the State Board of Corrections may charge\n\nany inmate for costs of incarceration, an amount equivalent to one\n\nhundred percent (100%) of any deposits from a workers’ compensation\n\nbenefit to such account.\n\n3. The Department of Corrections shall pay into the Crime\n\nVictims Compensation Revolving Fund, as provided in Section 142.17\n\nof Title 21 of the Oklahoma Statutes, an amount equal to five\n\npercent (5%) of the gross wages earned by inmates working in a\n\nprivate prison industries program, the amount to be paid from the\n\namount deducted for cost of incarceration.\n\n4. Withdrawals and deposits shall be made according to rules\n\nand regulations established by the State Board of Corrections.\n\nC. The Department of Corrections may assess costs of\n\nincarceration against all inmates. Such costs shall be a debt of\n\nthe inmate owed to the Department of Corrections and may be\n\ncollected as provided by law for collection of any other civil debt.\n\nIn addition to the provisions of this section authorizing\n\nexpenditure of inmate trust funds for costs of incarceration, any\n\nmonies received for costs of incarceration shall be deposited in the\n\nDepartment of Corrections Revolving Fund.","path":["OK Code","Title 57"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os57.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"6686fdbc66ace29af31fda29ee3e68e909e2e3df125116d39ef4a5f20c53760a","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-57-57-545","next":"us-ok/okla.-stat.-tit.-57-57-549.1"},"notice":"GroundRules: Original legal text.
