The Department of Corrections shall develop criteria for\n\nselection of a site upon which to construct the correctional\n\nfacilities described in subsection B of Section 183 of Title 73 of\n\nthe Oklahoma Statutes. The criteria shall include, but shall not be\n\nlimited to, the availability of medical services, support services,\n\ntransportation services, the availability of potential employees who\n\nwould be qualified to perform required functions at a state\n\ncorrectional facility and any benefits or incentives offered by the\n\napplicant. The criteria shall be subject to approval by the State\n\nBoard of Corrections.\n\nB. The Department of Corrections shall establish a process for\n\nrequesting proposals to construct a correctional facility built with\n\nthe funds authorized pursuant to Section 183 of Title 73 of the\n\nOklahoma Statutes.\n\nC. Proposals shall be submitted not later than thirty (30) days\n\nafter receipt of the request. The Department shall identify the\n\nproposals meeting the criteria approved pursuant to subsection A of\n\nthis section within thirty (30) days after receipt of the proposals.\n\nThe Department of Corrections shall identify by appropriate review\n\nand analysis the proposals submitted and shall select a maximum of\n\nthree proposals which conform to the criteria set out in subsection\n\nA of this section and shall forward the proposals meeting criteria\n\nto the State Board of Corrections.\n\nD. The Department of Corrections shall deliver to the State\n\nBoard of Corrections the top three qualified proposals identified\n\npursuant to this section together with the information reviewed and\n\nanalyzed by the Department of Corrections during analysis of the\n\nproposals as required by this section. The State Board of\n\nCorrections shall evaluate the information provided and shall make a\n\nfinal decision selecting the best site for the correctional facility\n\nwithin fifteen (15) days of receipt of the information.\n\nE. Any plans developed pursuant to the process for selection of\n\na contractor for construction of a facility authorized pursuant to\n\nSection 183 of Title 73 of the Oklahoma Statutes shall become the\n\nnonexclusive property of the State of Oklahoma as a condition of the\n\naward of the final contract for construction of the facility. The\n\nState of Oklahoma shall not be obligated to obtain any further\n\npermission for use of the plans or to make payment to any person or\n\nother legal entity for the further use of the plans as may be needed\n\nfor additional projects for site adaptation for buildings,\n\nstructures, or both, for use by the Department of Corrections.\n\nF. The Office of Management and Enterprise Services shall be\n\nresponsible for any changes or updates of such plans for\n\nconstruction of any additional correctional facility constructed\n\nusing the plans described in subsection E of this section. The\n\nDepartment of Transportation and the Office of Management and\n\nEnterprise Services shall provide such architectural, engineering\n\nand consulting services as the Department of Corrections may require\n\nin order to adapt existing plans for use in construction of\n\nadditional correctional facilities.\n\nG. If the Department of Corrections requires architectural,\n\nengineering or other consulting services in addition to those\n\nservices authorized by subsection F of this section, the Office of\n\nManagement and Enterprise Services shall be authorized to enter into\n\na contract with an architect, engineer or for other necessary\n\nservices, as may be required in order to adapt existing plans for\n\nnew sites for additional correctional facilities.
