Stat. tit. 57, § 57-571v2","heading":"Definitions","body":"As used in the Oklahoma Statutes, unless another definition is\n\nspecified:\n\n1. “Capacity” means the actual available bedspace as certified\n\nby the State Board of Corrections subject to applicable federal and\n\nstate laws and the rules and regulations promulgated under such\n\nlaws; and\n\n2. “Violent crime” means any of the following felony offenses\n\nand any attempts to commit or conspiracy or solicitation to commit\n\nthe following crimes:\n\na. assault, battery, or assault and battery with a\n\ndangerous or deadly weapon, as provided for in\n\nSections 645 and 652 of Title 21 of the Oklahoma\n\nStatutes,\n\nb. assault, battery, or assault and battery with a deadly\n\nweapon or by other means likely to produce death or\n\ngreat bodily harm, as provided for in Section 652 of\n\nTitle 21 of the Oklahoma Statutes,\n\nc. aggravated assault and battery on a police officer,\n\nsheriff, highway patrolman, or any other officer of\n\nthe law, as provided for in Section 650 of Title 21 of\n\nthe Oklahoma Statutes,\n\nd. poisoning with intent to kill, as provided for in\n\nSection 651 of Title 21 of the Oklahoma Statutes,\n\ne. shooting with intent to kill, as provided for in\n\nSection 652 of Title 21 of the Oklahoma Statutes,\n\nf. assault with intent to kill, as provided for in\n\nSection 653 of Title 21 of the Oklahoma Statutes,\n\ng. assault with intent to commit a felony, as provided\n\nfor in Section 681 of Title 21 of the Oklahoma\n\nStatutes,\n\nh. assaults with a dangerous weapon while masked or\n\ndisguised, as provided for in Section 1303 of Title 21\n\nof the Oklahoma Statutes,\n\ni. murder in the first degree, as provided for in Section\n\n701.7 of Title 21 of the Oklahoma Statutes,\n\nj. murder in the second degree, as provided for in\n\nSection 701.8 of Title 21 of the Oklahoma Statutes,\n\nk. manslaughter in the first degree, as provided for in\n\nSection 711 of Title 21 of the Oklahoma Statutes,\n\nl. manslaughter in the second degree, as provided for in\n\nSection 716 of Title 21 of the Oklahoma Statutes,\n\nm. kidnapping, as provided for in Section 741 of Title 21\n\nof the Oklahoma Statutes,\n\nn. burglary in the first degree, as provided for in\n\nSection 1431 of Title 21 of the Oklahoma Statutes,\n\no. burglary with explosives, as provided for in Section\n\n1441 of Title 21 of the Oklahoma Statutes,\n\np. kidnapping for extortion, as provided for in Section\n\n745 of Title 21 of the Oklahoma Statutes,\n\nq. maiming, as provided for in Section 751 of Title 21 of\n\nthe Oklahoma Statutes,\n\nr. robbery, as provided for in Section 791 of Title 21 of\n\nthe Oklahoma Statutes,\n\ns. robbery in the first degree, as provided for in\n\nSection 797 et seq. of Title 21 of the Oklahoma\n\nStatutes,\n\nt. robbery in the second degree, as provided for in\n\nSection 797 et seq. of Title 21 of the Oklahoma\n\nStatutes,\n\nu. armed robbery, as provided for in Section 801 of Title\n\n21 of the Oklahoma Statutes,\n\nv. robbery by two or more persons, as provided for in\n\nSection 800 of Title 21 of the Oklahoma Statutes,\n\nw. robbery with dangerous weapon or imitation firearm, as\n\nprovided for in Section 801 of Title 21 of the\n\nOklahoma Statutes,\n\nx. child abuse, as provided for in Section 843.5 of Title\n\n21 of the Oklahoma Statutes,\n\ny. wiring any equipment, vehicle, or structure with\n\nexplosives, as provided for in Section 849 of Title 21\n\nof the Oklahoma Statutes,\n\nz. forcible sodomy, as provided for in Section 888 of\n\nTitle 21 of the Oklahoma Statutes,\n\naa. rape in the first degree, as provided for in Section\n\n1114 of Title 21 of the Oklahoma Statutes,\n\nbb. rape in the second degree, as provided for in Section\n\n1114 of Title 21 of the Oklahoma Statutes,\n\ncc. rape by instrumentation, as provided for in Section\n\n1111.1 of Title 21 of the Oklahoma Statutes,\n\ndd. lewd or indecent proposition or lewd or indecent act\n\nwith a child under sixteen (16) years of age, as\n\nprovided for in Section 1123 of Title 21 of the\nof Title 21 of the Oklahoma Statutes,\n\nbb. rape in the second degree, as provided for in Section\n\n1114 of Title 21 of the Oklahoma Statutes,\n\ncc. rape by instrumentation, as provided for in Section\n\n1111.1 of Title 21 of the Oklahoma Statutes,\n\ndd. lewd or indecent proposition or lewd or indecent act\n\nwith a child under sixteen (16) years of age, as\n\nprovided for in Section 1123 of Title 21 of the\n\nOklahoma Statutes,\n\nee. use of a firearm or offensive weapon to commit or\n\nattempt to commit a felony, as provided for in Section\n\n1287 of Title 21 of the Oklahoma Statutes,\n\nff. pointing firearms, as provided for in Section 1289.16\n\nof Title 21 of the Oklahoma Statutes,\n\ngg. rioting, as provided for in Section 1311 of Title 21\n\nof the Oklahoma Statutes,\n\nhh. inciting to riot, as provided for in Section 1320.2 of\n\nTitle 21 of the Oklahoma Statutes,\n\nii. arson in the first degree, as provided for in Section\n\n1401 of Title 21 of the Oklahoma Statutes,\n\njj. injuring or burning public buildings, as provided for\n\nin Section 349 of Title 21 of the Oklahoma Statutes,\n\nkk. sabotage, as provided for in Section 1262 of Title 21\n\nof the Oklahoma Statutes,\n\nll. criminal syndicalism, as provided for in Section 1261\n\nof Title 21 of the Oklahoma Statutes,\n\nmm. extortion, as provided for in Section 1481 of Title 21\n\nof the Oklahoma Statutes,\n\nnn. obtaining signature by extortion, as provided for in\n\nSection 1485 of Title 21 of the Oklahoma Statutes,\n\noo. seizure of a bus, discharging firearm or hurling\n\nmissile at bus, as provided for in Section 1903 of\n\nTitle 21 of the Oklahoma Statutes,\n\npp. mistreatment of a mental patient, as provided for in\n\nSection 843.1 of Title 21 of the Oklahoma Statutes,\n\nqq. using a vehicle to facilitate the discharge of a\n\nweapon pursuant to Section 652 of Title 21 of the\n\nOklahoma Statutes,\n\nrr. bombing offenses as defined in Section 1767.1 of Title\n\n21 of the Oklahoma Statutes,\n\nss. child sexual abuse material or aggravated child sexual\n\nabuse material as defined in Section 1021.2, 1021.3,\n\n1024.1 or 1040.12a of Title 21 of the Oklahoma\n\nStatutes,\n\ntt. child sex trafficking as defined in Section 1030 of\n\nTitle 21 of the Oklahoma Statutes,\n\nuu. abuse of a vulnerable adult as defined in Section 10-\n\n103 of Title 43A of the Oklahoma Statutes,\n\nvv. aggravated trafficking as provided for in subsection C\n\nof Section 2-415 of Title 63 of the Oklahoma Statutes,\n\nww. aggravated assault and battery upon any person\n\ndefending another person from assault and battery, as\n\nprovided for in Section 646 of Title 21 of the\n\nOklahoma Statutes,\n\nxx. human trafficking, as provided for in Section 748 of\n\nTitle 21 of the Oklahoma Statutes,\n\nyy. terrorism crimes as provided in Section 1268 et seq.\n\nof Title 21 of the Oklahoma Statutes,\n\nzz. eluding a peace officer, as provided for in subsection\n\nB or C of Section 540A of Title 21 of the Oklahoma\n\nStatutes, or\n\naaa. domestic abuse by strangulation, a subsequent offense\n\nof domestic assault and battery, domestic assault with\n\na dangerous weapon, domestic assault and battery with\n\na dangerous weapon, domestic assault and battery\n\nresulting in great bodily injury, domestic assault and\n\nbattery with a deadly weapon, or domestic abuse\n\nagainst a pregnant woman with knowledge of the\n\npregnancy as provided for in Section 644 of Title 21\n\nof the Oklahoma Statutes.\n\nSuch offenses shall constitute exceptions to nonviolent offenses\n\npursuant to Article VI, Section 10 of the Oklahoma Constitution.","path":["OK Code","Title
