The Department of Corrections shall promulgate rules and\n\nestablish procedures necessary to allow the eligibility of certain\n\noffenders to be considered for parole to a private, stand-alone,\n\nlong-term care facility for any offender deemed by the Department of\n\nCorrections to be either terminally ill or progressively debilitated\n\nas defined by the medical profession.\n\nB. For the purpose of this section:\n\n1. Terminally ill means having a condition that reasonably may\n\nbe expected to result in death within twenty-four (24) months; and\n\n2. Long-term care facility means a health care facility, other\n\nthan a general acute or specialty hospital, constructed, licensed,\n\nand operated to provide patient living accommodations, twenty-four-\n\nhour staff availability, and at least two of the following patient\n\nservices:\n\na. a selection of patient care services, under the\n\ndirection and supervision of a registered nurse,\n\nranging from continuous medical, skilled nursing,\n\npsychological, or other professional therapies to\n\nintermittent health-related or paraprofessional care\n\nservices, and\n\nb. a structured supportive living environment that\n\nprovides support or assistance with individual\n\nactivities of daily living.\n\nC. The Department of Corrections will create a list of\n\noffenders eligible for parole to the private, stand-alone, long-term\n\ncare facility to be provided to the Oklahoma Pardon and Parole Board\n\nfor consideration.\n\nD. Eligible offenders shall not include offenders who are\n\nsentenced as follows:\n\n1. Death row inmates;\n\n2. Life without possibility of parole; or\n\n3.
