The district court has probate jurisdiction, and the judge\n\nthereof power, which must be exercised in the cases and in the\n\nmanner prescribed by statute:\n\n1. To open and receive proof of last wills and testaments, and\n\nto admit them to proof and to revoke the probate thereof, and to\n\nallow and record foreign wills;\n\n2. To grant letters testamentary, of administration and of\n\nguardianship, and to revoke the same;\n\n3. To appoint appraisers of estates of deceased persons and of\n\nminors and incapacitated persons;\n\n4. To compel personal representatives and guardians to render\n\naccounts;\n\n5. To order the sale of property of estates, or belonging to\n\nminors or to incapacitated persons;\n\n6. To order the payments of debts from estates or\n\nguardianships;\n\n7. To order and regulate all distribution of property or\n\nestates of deceased persons;\n\n8. To compel the attendance of witnesses and the production of\n\ntitle deeds, papers, and other property of an estate, or of a minor,\n\nor incapacitated persons;\n\n9. To exercise all the powers conferred by this chapter or by\n\nother law;\n\n10. To make such orders as may be necessary to the exercise of\n\nthe powers conferred upon it; and\n\n11. To appoint and remove guardians for infants, and for\n\npersons insane or who are otherwise incapacitated persons; to compel\n\npayment and delivery by them of money or property belonging to their\n\nwards, to control their conduct and settle their accounts.\n\nB. The district court which has jurisdiction and venue of the\n\nadministration of any estate is granted jurisdiction and venue to\n\ncause Oklahoma and federal estate taxes to be equitably apportioned\n\nand collected.\n\nC. The district court which has jurisdiction and venue of the\n\nadministration of any estate is granted unlimited concurrent\n\njurisdiction and venue to hear and determine:\n\n1. In whom the title to any property is vested, whether the\n\nproperty is real, personal, tangible, intangible, or any combination\n\nthereof;\n\n2. Rights with respect to such property as to all persons and\n\nentities;\n\n3. Whether or not such property is subject to the jurisdiction\n\nof the court in the decedent's estate; and\n\n4. Issues relating to trusts or issues involving a guardian or\n\nward that may arise.\n\nD. For proceedings under subsection C of this section, service\n\nof notice and process shall be required as in other cases and the\n\nprovisions of the Oklahoma Pleading Code, Section 2001 et seq. of\n\nTitle 12 of the Oklahoma Statutes, shall be followed.\n\nR.L. 1910, § 6189.
