Custodial property is created and a transfer is made\n\nwhenever:\n\n1. An uncertificated security or a certificated security in\n\nregistered form is either:\n\na. registered in the name of the transferor, an adult\n\nother than the transferor, or a trust company,\n\nfollowed in substance by the words: \"as custodian for\n\n__________________ (name of minor) under the Oklahoma\n\nUniform Transfers to Minors Act\"; or\n\nb. delivered if in certificated form, or any document\n\nnecessary for the transfer of an uncertificated\n\nsecurity is delivered, together with any necessary\n\nendorsement to an adult other than the transferor or\n\nto a trust company as custodian, accompanied by an\n\ninstrument in substantially the form set forth in\n\nsubsection B of this section; or\n\n2. Money is paid or delivered or a security held in the name of\n\na broker, financial institution, or its nominee is transferred to a\n\nbroker or financial institution for credit to an account in the name\n\nof the transferor, an adult other than the transferor, or a trust\n\ncompany, followed in substance by the words: \"as custodian for\n\n__________________ (name of minor) under the Oklahoma Uniform\n\nTransfers to Minors Act\". Money paid or delivered to a financial\n\ninstitution as prescribed in this paragraph also may be deposited\n\nusing the terms \"Payable on Death\" or \"P.O.D.\", in which case, such\n\ndeposits shall be payable on the designated minor's death to a trust\n\ndesignated in the deposit account agreement as the \"P.O.D.\"\n\nbeneficiary, or to an individual named beneficiary if living and if\n\nnot living, to the named beneficiary's estate, notwithstanding any\n\nprovision to the contrary contained in Sections 41 through 57 of\n\nTitle 84 of the Oklahoma Statutes. A security held or transferred\n\nas prescribed in this paragraph also may be subject to a beneficiary\n\ndesignation pursuant to the Oklahoma Uniform TOD Security\n\nRegistration Act, in which case, the security shall be transferable\n\non the designated minor's death to a named beneficiary, if living\n\nand if not living, to the named beneficiary's estate,\n\nnotwithstanding any provision to the contrary contained in Sections\n\n41 through 57 of Title 84 of the Oklahoma Statutes; or\n\n3. The ownership of a life or endowment insurance policy or\n\nannuity contract is either:\n\na. registered with the issuer in the name of the\n\ntransferor, an adult other than the transferor, or a\n\ntrust company, followed in substance by the words: \"as\n\ncustodian for __________________ (name of minor) under\n\nthe Oklahoma Uniform Transfers to Minors Act\"; or\n\nb. assigned in a writing delivered to an adult other than\n\nthe transferor or to a trust company whose name in the\n\nassignment is followed in substance by the words: \"as\n\ncustodian for __________________ (name of minor) under\n\nthe Oklahoma Uniform Transfers to Minors Act\"; or\n\n4. An irrevocable exercise of a power of appointment or an\n\nirrevocable present right to future payment under a contract is the\n\nsubject of a written notification delivered to the payor, issuer, or\n\nother obligor that the right is transferred to the transferor, an\n\nadult other than the transferor, or a trust company, whose name in\n\nthe notification is followed in substance by the words: \"as\n\ncustodian for __________________ (name of minor) under the Oklahoma\n\nUniform Transfers to Minors Act\"; or\n\n5. An interest in real property is recorded in the name of the\n\ntransferor, an adult other than the transferor, or a trust company,\n\nfollowed in substance by the words: \"as custodian for\n\n__________________ (name of minor) under the Oklahoma Uniform\n\nTransfers to Minors Act\"; or\n\n6. A certificate of title issued by a department or agency of a\n\nstate or of the United States which evidences title to tangible\n\npersonal property is either:\n\na. issued in the name of the transferor, an adult other\nthe transferor, or a trust company,\n\nfollowed in substance by the words: \"as custodian for\n\n__________________ (name of minor) under the Oklahoma Uniform\n\nTransfers to Minors Act\"; or\n\n6. A certificate of title issued by a department or agency of a\n\nstate or of the United States which evidences title to tangible\n\npersonal property is either:\n\na. issued in the name of the transferor, an adult other\n\nthan the transferor, or a trust company, followed in\n\nsubstance by the words: \"as custodian for\n\n__________________ (name of minor) under the Oklahoma\n\nUniform Transfers to Minors Act\"; or\n\nb. delivered to an adult other than the transferor or to\n\na trust company, endorsed to that person followed in\n\nsubstance by the words: \"as custodian for\n\n__________________ (name of minor) under the Oklahoma\n\nUniform Transfers to Minors Act\"; or\n\n7. An interest in any property not described in paragraphs 1,\n\n2, 3, 4, 5 and 6 is transferred to an adult other than the\n\ntransferor or to a trust company by a written instrument in\n\nsubstantially the form set forth in subsection B of this section.\n\nB. An instrument in the following form satisfies the\n\nrequirements of subparagraph b of paragraph 1 and paragraph 7 of\n\nsubsection A of this section:\n\n\"TRANSFER UNDER THE OKLAHOMA UNIFORM TRANSFERS TO MINORS ACT\n\nI, _________________ (name of transferor or name and\n\nrepresentative capacity if a fiduciary) hereby transfer to\n\n__________________ (name of custodian), as custodian for\n\n__________________ (name of minor) under the Oklahoma Uniform\n\nTransfers to Minors Act, the following: (insert a description of the\n\ncustodial property sufficient to identify it).\n\nDated: _________________________\n\n__________________________________________\n\n(Signature)\n\n_________________________ (name of custodian) acknowledges receipt\n\nof the property described above as custodian for the minor named\n\nabove under the Oklahoma Uniform Transfers to Minors Act.\n\nDated: ___________________\n\n_________________________________________\"\n\n(Signature of Custodian)\n\nC.
