Stat. tit. 58, § 58-176","heading":"Justification of sureties - Approval of bond - Examination","body":"of sureties.\n\nIn all cases where bonds are required to be given, under this\n\ntitle, the officer taking the same must require the sureties to\n\naccompany it with an affidavit that they are each residents and\n\nhouseholders or freeholders within the state, and are each worth the\n\nsum specified in the bond, over and above all their just debts and\n\nliabilities, exclusive of property exempt from execution; but when\n\nthe amount specified in the bond exceeds One Thousand Dollars\n\n($1,000.00), and there are more than two sureties thereon, they may\n\nstate in their affidavits that they are severally worth amounts less\n\nthan that expressed in the bond, if the whole amount be equivalent\n\nto that of two sufficient sureties, and the affidavits thereof must\n\nbe attached to, and filed and recorded with the bond. All such\n\nbonds must be approved by the judge of the district court before\n\nbeing filed and recorded. Before the judge of the district court\n\napproves any bond required under this title, and after its approval\n\nhe may of his own motion, or upon the motion of any person\n\ninterested in the estate, supported by affidavit that the sureties\n\nor some one or more of them are not worth as much as they have\n\njustified to, issue a citation, requiring such sureties to appear\n\nbefore him, at a designated time and place, to be examined touching\n\ntheir property and its value; and the judge must, at the same time,\n\nissue a notice to the executor or administrator, requiring his\n\nappearance on the return of the citation, and on its return he may\n\nexamine the sureties and such witnesses as may be produced, touching\n\nthe property of the sureties and its value; and if, upon such\n\nexamination, he is satisfied that the bond is insufficient, he must\n\nrequire sufficient additional security.","path":["OK Code","Title 58"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os58.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"6d911b96ce1bd75ebb8c3b76e5cf6b83ad33f39bf8849b895e6c428daa351e6b","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-58-58-175","next":"us-ok/okla.-stat.-tit.-58-58-177"},"notice":"GroundRules: Original legal text.
