Whenever the judge has reason to believe, from his own\n\nknowledge or from credible information, that any executor or\n\nadministrator has wasted, embezzled or mismanaged, or is about to\n\nwaste, or embezzle the property of the estate committed to his\n\ncharge, or has committed or is about to commit a fraud upon the\n\nestate, or is incompetent to act or has wrongfully neglected the\n\nestate, or has long neglected to perform any act as such executor or\n\nadministrator, he must, by an order entered upon the minutes of the\n\ncourt, suspend the powers of such executor or administrator until\n\nthe matter is investigated.\n\nB. If the judge determines on his own motion, or upon\n\napplication by an interested party and upon proper showing, that an\n\nexecutor or administrator is subject to a conflict of interest which\n\nsubstantially impairs the executor's or administrator's ability to\n\nperform his duties as required by law, the judge shall suspend the\n\npowers of the executor or administrator with respect to the subject\n\nmatter of the conflict of interest and appoint a special\n\nadministrator to act with respect to such subject matter. The\n\nexecutor or administrator shall remain empowered to act with respect\n\nto all other matters.\n\nC.
