If a petition is filed for the appointment of a personal\n\nrepresentative and the petitioner requests that the identity of the\n\nheirs, devisees and legatees be determined at the initial hearing\n\nand the notice of hearing such petition reflects such request, then\n\nat the first hearing on a petition to admit a will to probate or a\n\npetition for the appointment of a personal representative in an\n\nintestate proceeding, the court may determine the identity of all\n\nheirs, devisees and legatees, and any guardian or conservator of any\n\nminor or incompetent heir, devisee or legatee.\n\nB. If the petition filed for the appointment of a personal\n\nrepresentative or the notice of hearing such petition does not\n\ncontain or reflect a request that the identity of the heirs,\n\ndevisees and legatees be determined at the initial hearing, the\n\npersonal representative may, at any time during the course of\n\nadministration, file with the court a petition requesting that the\n\nidentity of the heirs, devisees and legatees be determined. Such\n\npetition shall be heard following at least ten (10) days' prior\n\nnotice to the heirs, devisees and legatees.\n\nC. If the petition requests the appointment of an administrator\n\nand the court determines that the petition can be heard without\n\nnotice pursuant to the provisions of Section 128 of this title, and\n\nthe petition also contains a request that the identity of the heirs\n\nof the intestate decedent be determined, the court may proceed to\n\nappoint the administrator without notice and set such petition for\n\nhearing, following at least ten (10) days' prior notice to the\n\nheirs, with respect to the request that the identity of the heirs,\n\nlegatees and devisees be determined.\n\nD. Any determination of heirs, legatees and devisees made\n\npursuant to this section shall be conclusive for the purpose of\n\nacting upon any petition or application purporting to include\n\nwaivers or consents of all heirs, devisees and legatees, but shall\n\nnot establish the proportional interest of any person entitled to\n\nreceive any distribution of assets or property from the estate; nor\n\nshall it prevent any person or entity from later establishing\n\nidentity or rights as an heir, devisee or legatee.","path":["OK Code","Title 58"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os58.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"7342d48db79835d93d294dfa1fe916079c358df93b738dcc5a3c9aa0f85be7e2","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-58-58-24.1","next":"us-ok/okla.-stat.-tit.-58-58-241"},"notice":"GroundRules: Original legal text.
