If, upon filing a petition for probate and after the\n\nappointment of the personal representative, it appears that the\n\nvalue of the real and personal property in the estate does not\n\nexceed One Hundred Fifty Thousand Dollars ($150,000.00), the court\n\nshall order the personal representative to make an inventory of the\n\nestate, and the court shall appoint appraisers unless the court\n\ndetermines that appraisement is not necessary.\n\nB. If, upon return of the inventory of the estate of the\n\ndecedent, and appraisement of the estate if required, it appears\n\nthat the value of the whole estate, both real and personal property,\n\ndoes not exceed One Hundred Fifty Thousand Dollars ($150,000.00),\n\nand upon application of the personal representative, the court shall\n\ndispense with the regular proceedings or any part thereof prescribed\n\nby law, and the court shall order notice to creditors, and issue\n\norder for hearing upon the final accounting and petition for\n\ndetermination of heirship, distribution and discharge; provided,\n\nnothing herein shall affect the lien upon any property for any\n\nestate or transfer tax which may be due upon the estate of the\n\ndecedent.\n\nC. Notice to creditors and notice of hearing upon the final\n\naccounting and petition for determination of heirship, distribution\n\nand discharge shall be published once each week for two (2)\n\nconsecutive weeks in some newspaper of general circulation,\n\npublished in the county where the probate is filed. If there is no\n\nlegal newspaper in a county, then all such notices required by this\n\nsubsection shall be published in a legal newspaper in an adjoining\n\ncounty having a legal newspaper. Notice to creditors and notice of\n\nhearing upon the final accounting, determination of heirship,\n\ndistribution and discharge may be combined in one notice, referred\n\nto as a \"combined notice\". The notice to creditors or combined\n\nnotice shall be mailed to creditors of the decedent as provided in\n\nSections 331 and 331.1 of this title. Creditors shall file claims\n\nagainst the estate with the personal representative or the attorney\n\nfor personal representative within thirty (30) days after the\n\npublication of the notice. Notice of the hearing or the combined\n\nnotice shall be mailed to all persons interested in the estate of\n\nthe decedent at their respective last-known addresses not less than\n\nten (10) days prior to the date of the hearing, and the notice shall\n\nset forth a date by which final account and petition for\n\ndistribution will be filed. The date of the filing shall precede by\n\nat least five (5) days the order allowing final accounting,\n\ndetermination of heirs, and of legatees and devisees, if any, and\n\ndistribution.\n\nD. The matter shall be set for hearing not less than thirty-\n\nfive (35) days following the first publication of notice to\n\ncreditors or combined notice, and upon the hearing the court shall,\n\nafter proof of payment of funeral expenses, expenses of last\n\nsickness and of administration and allowed claims, issue an order\n\nallowing the final accounting, determining heirship and the legatees\n\nand devisees, if any, of the decedent, distributing the property of\n\nthe estate and discharging the personal representative and surety or\n\nsureties on the personal representative's bond, or defer such\n\ndischarge if in the discretion of the court such deferral is\n\nnecessary or desirable.","path":["OK Code","Title 58"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os58.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"7a1c7d4983a4ee75f9ad4a016bae352667eb8de8e8e973865e46cf82f050db96","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-58-58-240","next":"us-ok/okla.-stat.-tit.-58-58-242"},"notice":"GroundRules: Original legal text.
