Stat. tit. 58, § 58-262","heading":"Foreign executors and administrators - Right of action -","body":"Proof of authority - Security - Release of mortgages.\n\nIt shall be lawful for any person or persons to whom letters\n\ntestamentary or of administration have been granted, by the proper\n\nauthority in any of the United States or the territories thereof, to\n\nmaintain or defend any suit or action, and to prosecute and recover\n\nany claim in the courts of the State of Oklahoma, in the same manner\n\nas if the letters testamentary or of administration had been granted\n\nto such person by the proper authority in this state, and the\n\nletters testamentary or of administration, or a copy thereof,\n\ncertified under the seal of the authority granting the same, shall\n\nbe sufficient evidence to prove the granting thereof, and that the\n\nperson therein named has administration; Provided, that the courts\n\nin which any action may be brought by any nonresident executor or\n\nadministrator shall have power, and such power is hereby given to\n\nthe said court, upon motion, to require from such person the\n\nsecurity required by law in a like case from a resident\n\nadministrator or executor; Provided, further, that such executor or\n\nadministrator shall have the authority to release mortgages in this\n\nstate upon filing with the county clerk of the county in which such\n\nmortgage is recorded a showing properly certified to that such\n\nexecutor or administrator is the duly qualified and acting executor\n\nor administrator of such estate.","path":["OK Code","Title 58"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os58.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"79173ce6fbed1237e448b6f5dfa737f69bc0e9ab4c226bd2247c2de235692d90","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-58-58-261","next":"us-ok/okla.-stat.-tit.-58-58-263"},"notice":"GroundRules: Original legal text.
