Stat. tit. 58, § 58-263","heading":"Conducting going business","body":"The executor or administrator shall have the power, where\n\nauthorized by order of the district court, to take charge of,\n\nconduct and continue any going business, enterprise or manufactory\n\nof a deceased person, when the same has not been disposed of by\n\nwill, and where it is not necessary that the same be sold at once\n\nfor the payment of debts; and shall have the right to borrow money\n\nand incur indebtedness in the conduct, or continuation of such\n\nbusiness. Before such business, manufactory or enterprise shall be\n\ncontinued, the executor or administrator shall take into\n\nconsideration the condition of the estate and the necessity that may\n\nexist for the future sale of said property for the payment of claims\n\nor legacies; and the time for conducting such enterprise, business\n\nor manufactory shall not extend the time beyond what may be\n\nconsidered by the court a reasonable time for the settlement of the\n\nestate of the deceased; provided, however, that before any executor\n\nor administrator shall continue such enterprise, business or\n\nmanufactory, or incur any indebtedness in the conduct of such\n\nenterprise, business or manufactory, he shall first present to the\n\ndistrict court a petition showing that it is to the best interest of\n\nthe estate of the decedent that such enterprise, business or\n\nmanufactory be continued, and the continuation of such business,\n\nenterprise or manufactory must first be approved by the judge of the\n\ndistrict court having jurisdiction of the settlement of the estate\n\nof the deceased.","path":["OK Code","Title 58"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os58.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"0623debb6dd383bb035c1bdcd1c0d3b8e5d1871cc3b9929747ea262a16595346","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-58-58-262","next":"us-ok/okla.-stat.-tit.-58-58-264"},"notice":"GroundRules: Original legal text.
