Stat. tit. 58, § 58-3002","heading":"Definitions","body":"As used in this act:\n\n1. \"Agent\" means a person granted authority to act for a\n\nprincipal under a power of attorney, whether denominated an agent,\n\nattorney-in-fact or otherwise. The term includes an original agent,\n\ncoagent, successor agent and a person to which an agent's authority\n\nis delegated;\n\n2. \"Durable\", with respect to a power of attorney, means not\n\nterminated by the principal's incapacity;\n\n3. \"Electronic\" means relating to technology having electrical,\n\ndigital, magnetic, wireless, optical, electromagnetic or similar\n\ncapabilities;\n\n4. \"Good faith\" means honesty in fact;\n\n5. \"Incapacity\" means inability of an individual to manage\n\nproperty or business affairs because the individual:\n\na. has an impairment in the ability to receive and\n\nevaluate information or make or communicate decisions\n\neven with the use of technological assistance, or\n\nb. is:\n\n(1) missing,\n\n(2) detained, including incarcerated in a penal\n\nsystem, or\n\n(3) outside the United States and unable to return;\n\n6. \"Person\" means an individual, corporation, business trust,\n\nestate, trust, partnership, limited liability company (LLC),\n\nassociation, joint venture, public corporation, government or\n\ngovernmental subdivision, agency or instrumentality, or any other\n\nlegal or commercial entity;\n\n7. \"Power of attorney\" means a writing or other record that\n\ngrants authority to an agent to act in the place of the principal,\n\nwhether or not the term power of attorney is used;\n\n8. \"Presently exercisable general power of appointment\", with\n\nrespect to property or a property interest subject to a power of\n\nappointment, means power exercisable at the time in question to vest\n\nabsolute ownership in the principal individually, the principal's\n\nestate, the principal's creditors or the creditors of the\n\nprincipal's estate. The term includes a power of appointment not\n\nexercisable until the occurrence of a specified event, the\n\nsatisfaction of an ascertainable standard or the passage of a\n\nspecified period only after the occurrence of the specified event,\n\nthe satisfaction of the ascertainable standard or the passage of the\n\nspecified period. The term does not include a power exercisable in\n\na fiduciary capacity or only by will;\n\n9. \"Principal\" means an individual who grants authority to an\n\nagent in a power of attorney;\n\n10. \"Property\" means anything that may be the subject of\n\nownership, whether real or personal, or legal or equitable, or any\n\ninterest or right therein;\n\n11. \"Record\" means information that is inscribed on a tangible\n\nmedium or that is stored in an electronic or other medium and is\n\nretrievable in perceivable form;\n\n12. \"Sign\" means, with present intent to authenticate or adopt\n\na record:\n\na. to execute or adopt a tangible symbol, or\n\nb. to attach to or logically associate with the record an\n\nelectronic sound, symbol or process;\n\n13. \"State\" means a state of the United States, the District of\n\nColumbia, Puerto Rico, the United States Virgin Islands or any\n\nterritory or insular possession subject to the jurisdiction of the\n\nUnited States; and\n\n14. \"Stocks and bonds\" means stocks, bonds, mutual funds and\n\nall other types of securities and financial instruments, whether\n\nheld directly, indirectly or in any other manner.
