A power of attorney is effective when executed unless the\n\nprincipal provides in the power of attorney that it becomes\n\neffective at a future date or upon the occurrence of a future event\n\nor contingency.\n\nB. If a power of attorney becomes effective upon the occurrence\n\nof a future event or contingency, the principal, in the power of\n\nattorney, may authorize one or more persons to determine in a\n\nwriting or other record that the event or contingency has occurred.\n\nC. If a power of attorney becomes effective upon the\n\nprincipal's incapacity and the principal has not authorized a person\n\nto determine whether the principal is incapacitated, or the person\n\nauthorized is unable or unwilling to make the determination, the\n\npower of attorney becomes effective upon a determination in a\n\nwriting or other record by:\n\n1. A physician or licensed psychologist that the principal is\n\nincapacitated within the meaning of subparagraph a of paragraph 5 of\n\nSection 2 of this act; or\n\n2. An attorney at law, a judge or an appropriate governmental\n\nofficial that the principal is incapacitated within the meaning of\n\nsubparagraph b of paragraph 5 of Section 2 of this act.\n\nD.
