Stat. tit. 58, § 58-3019","heading":"Acceptance of and reliance upon acknowledged power of","body":"attorney.\n\nA. For purposes of this section and Section 20 of this act,\n\n\"acknowledged\" means purportedly verified before a notary public or\n\nother individual authorized to take acknowledgements.\n\nB. A person that in good faith accepts an acknowledged power of\n\nattorney without actual knowledge that the signature is not genuine\n\nmay rely upon the presumption under Section 5 of this act that the\n\nsignature is genuine.\n\nC. A person that in good faith accepts an acknowledged power of\n\nattorney without actual knowledge that the power of attorney is\n\nvoid, invalid or terminated, that the purported agent's authority is\n\nvoid, invalid or terminated, or that the agent is exceeding or\n\nimproperly exercising the agent's authority may rely upon the power\n\nof attorney as if the power of attorney were genuine, valid and\n\nstill in effect, the agent's authority were genuine, valid and still\n\nin effect, and the agent had not exceeded and had properly exercised\n\nthe authority.\n\nD. A person that is asked to accept an acknowledged power of\n\nattorney may request, and rely upon, without further investigation:\n\n1. An agent's certification under penalty of perjury of any\n\nfactual matter concerning the principal, agent or power of attorney;\n\n2. An English translation of the power of attorney if the power\n\nof attorney contains, in whole or in part, language other than\n\nEnglish; and\n\n3. An opinion of counsel as to any matter of law concerning the\n\npower of attorney if the person making the request provides in a\n\nwriting or other record the reason for the request.\n\nE. An English translation or an opinion of counsel requested\n\nunder this section must be provided at the principal's expense\n\nunless the request is made more than seven (7) business days after\n\nthe power of attorney is presented for acceptance.\n\nF.
