Stat. tit. 58, § 58-3102","heading":"Definitions","body":"As used in this act:\n\n1. \"Account\" means an arrangement under a terms-of-service\n\nagreement in which a custodian carries, maintains, processes,\n\nreceives, or stores a digital asset of the user or provides goods or\n\nservices to the user;\n\n2. \"Agent\" means an attorney-in-fact granted authority under a\n\ndurable or nondurable power of attorney;\n\n3. \"Carries\" means engages in the transmission of an electronic\n\ncommunication;\n\n4. \"Catalog of electronic communications\" means information\n\nthat identifies each person with which a user has had an electronic\n\ncommunication, the time and date of the communication, and the\n\nelectronic address of the person;\n\n5. \"Guardian\" means a person appointed by a court to manage the\n\nestate of a living individual. The term includes a limited\n\nguardian;\n\n6. \"Content of an electronic communication\" means information\n\nconcerning the substance or meaning of the communication which:\n\na. has been sent or received by a user,\n\nb. is in electronic storage by a custodian providing an\n\nelectronic-communication service to the public or is\n\ncarried or maintained by a custodian providing a\n\nremote-computing service to the public, and\n\nc. is not readily accessible to the public;\n\n7. \"Court\" means the court of proper jurisdiction;\n\n8. \"Custodian\" means a person who carries, maintains,\n\nprocesses, receives, or stores a digital asset of a user;\n\n9. \"Designated recipient\" means a person chosen by a user using\n\nan online tool to administer digital assets of the user;\n\n10. \"Digital asset\" means an electronic record in which an\n\nindividual has a right or interest. The term does not include an\n\nunderlying asset or liability unless the asset or liability is\n\nitself an electronic record;\n\n11. \"Electronic\" means relating to technology having\n\nelectrical, digital, magnetic, wireless, optical, electromagnetic,\n\nor similar capabilities;\n\n12. \"Electronic communication\" has the meaning set forth in 18\n\nU.S.C., Section 2510(12);\n\n13. \"Electronic-communication service\" means a custodian that\n\nprovides a user the ability to send or receive an electronic\n\ncommunication;\n\n14. \"Fiduciary\" means an original, additional, or successor\n\npersonal representative, guardian, agent, or trustee;\n\n15. \"Information\" means data, text, images, videos, sounds,\n\ncodes, computer programs, software, databases, or the like;\n\n16. \"Online tool\" means an electronic service provided by a\n\ncustodian that allows the user, in an agreement distinct from the\n\nterms-of-service agreement between the custodian and user, to\n\nprovide directions for disclosure or nondisclosure of digital assets\n\nto a third person;\n\n17. \"Person\" means an individual, estate, business or nonprofit\n\nentity, public corporation, government or governmental subdivision,\n\nagency, or instrumentality, or other legal entity;\n\n18. \"Personal representative\" means an executor, administrator,\n\nspecial administrator, or person that performs substantially the\n\nsame function under the laws of this state other than this act;\n\n19. \"Power of attorney\" means a record that grants an agent\n\nauthority to act in the place of a principal;\n\n20. \"Principal\" means an individual who grants authority to an\n\nagent in a power of attorney;\n\n21. \"Protected person\" means an individual for whom a guardian\n\nhas been appointed. The term includes an individual for whom an\n\napplication for the appointment of a guardian is pending;\n\n22. \"Record\" means information that is inscribed on a tangible\n\nmedium or that is stored in an electronic or other medium and is\n\nretrievable in perceivable form;\n\n23. \"Remote-computing service\" means a custodian that provides\n\nto a user computer processing services or the storage of digital\n\nassets by means of an electronic communications system, as defined\n\nin 18 U.S.C., Section 2510(14);\n\n24. \"Terms-of-service agreement\" means an agreement that\n\ncontrols the relationship between a user and a custodian;\nther medium and is\n\nretrievable in perceivable form;\n\n23. \"Remote-computing service\" means a custodian that provides\n\nto a user computer processing services or the storage of digital\n\nassets by means of an electronic communications system, as defined\n\nin 18 U.S.C., Section 2510(14);\n\n24. \"Terms-of-service agreement\" means an agreement that\n\ncontrols the relationship between a user and a custodian;\n\n25. \"Trustee\" means a fiduciary with legal title to property\n\nunder an agreement or declaration that creates a beneficial interest\n\nin another.
