Stat. tit. 58, § 58-3107","heading":"Disclosure of electronic communications content of","body":"deceased user.\n\nIf a deceased user consented or a court directs disclosure of\n\nthe contents of electronic communications of the user, the custodian\n\nshall disclose to the personal representative of the estate of the\n\nuser the content of an electronic communication sent or received by\n\nthe user if the representative gives the custodian:\n\n1. A written request for disclosure in physical or electronic\n\nform;\n\n2. A certified copy of the death certificate of the user;\n\n3. A certified copy of the letter of appointment of the\n\nrepresentative or a small-estate affidavit or court order;\n\n4. Unless the user provided direction using an online tool, a\n\ncopy of the user's will, trust, power of attorney, or other record\n\nevidencing the user's consent to disclosure of the content of\n\nelectronic communications; and\n\n5. If requested by the custodian:\n\na. a number, username, address, or other unique\n\nsubscriber or account identifier assigned by the\n\ncustodian to identify the user's account,\n\nb. evidence linking the account to the user, or\n\nc. a finding by the court that:\n\n(1) the user had a specific account with the\n\ncustodian, identifiable by the information\n\nspecified in subparagraph a of paragraph 5 of\n\nthis section,\n\n(2) disclosure of the content of electronic\n\ncommunications of the user would not violate 18\n\nU.S.C., Section 2701 et seq., 47 U.S.C., Section\n\n222, or other applicable law,\n\n(3) unless the user provided direction using an\n\nonline tool, the user consented to disclosure of\n\nthe content of electronic communications, or\n\n(4) disclosure of the content of electronic\n\ncommunications of the user is reasonably\n\nnecessary for administration of the estate.","path":["OK Code","Title 58"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os58.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"69b5a9403c1abade99b307d8c0b9c7cd5382309d5dd807dce795e15b92af8551","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-58-58-3106","next":"us-ok/okla.-stat.-tit.-58-58-3108"},"notice":"GroundRules: Original legal text.
