Stat. tit. 58, § 58-3108","heading":"Disclosure of electronic communications catalog of","body":"deceased user.\n\nUnless the user prohibited disclosure of digital assets or the\n\ncourt directs otherwise, a custodian shall disclose to the personal\n\nrepresentative of the estate of a deceased user, a catalog of\n\nelectronic communications sent or received by the user and digital\n\nassets, other than the content of electronic communications, of the\n\nuser, if the representative gives the custodian:\n\n1. A written request for disclosure in physical or electronic\n\nform;\n\n2. A certified copy of the death certificate of the user;\n\n3. A certified copy of the letter of appointment of the\n\nrepresentative or a small-estate affidavit or court order; and\n\n4. If requested by the custodian:\n\na. a number, username, address, or other unique\n\nsubscriber or account identifier assigned by the\n\ncustodian to identify the user's account,\n\nb. evidence linking the account to the user,\n\nc. an affidavit stating that disclosure of the user's\n\ndigital assets is reasonably necessary for\n\nadministration of the estate, or\n\nd. a finding by the court that:\n\n(1) the user had a specific account with the\n\ncustodian, identifiable by the information\n\nspecified in subparagraph a of paragraph 4 of\n\nthis section, or\n\n(2) disclosure of the user's digital assets is\n\nreasonably necessary for administration of the\n\nestate.","path":["OK Code","Title 58"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os58.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"113e179ceabe7ffe1ceb54079b0821d31ffeebae69cb83656cb50ce42adbbfde","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-58-58-3107","next":"us-ok/okla.-stat.-tit.-58-58-3109"},"notice":"GroundRules: Original legal text.
