Stat. tit. 58, § 58-331","heading":"Notice to creditors to present claims","body":"Every personal representative must, unless the notice has been\n\ngiven by a special administrator as provided in Section 215 of this\n\ntitle, within two (2) months after the issuance of his letters, file\n\nnotice to the creditors of the decedent stating that claims against\n\nsaid deceased will be forever barred unless presented to such\n\npersonal representative, at the personal representative's place of\n\nresidence or business, or at the place of business of the attorney\n\nfor the personal representative, as specified in the notice, by the\n\npresentment date stated in the notice. The presentment date shall\n\nbe a date certain which is at least two (2) months following the\n\ndate said notice is filed, and the first publication of said notice\n\nshall appear on or before the tenth day after the filing of said\n\nnotice. If the presentment date stated is a Saturday, Sunday, or\n\nlegal holiday, the presentment date shall be deemed to be the next\n\nsucceeding day which is not a Saturday, Sunday, or legal holiday.\n\nThe notice to creditors shall be given by publication in some\n\nnewspaper in the county in which the probate is filed once each week\n\nfor two (2) consecutive weeks, and by mail to all known creditors of\n\nthe decedent at their respective last-known available addresses, in\n\naccordance with Section 6 of this act. The notice shall be\n\nsubstantially in the following form:\n\nAll creditors having claims against A B, deceased, are required\n\nto present the same, with a description of all security interests\n\nand other collateral (if any) held by each creditor with respect to\n\nsuch claim, to the named personal representative at ______ (address\n\nof the personal representative or attorney for the personal\n\nrepresentative) on or before the following presentment date:\n\n_________________, or the same will be forever barred.\n\nC D, Personal Representative\n\nfor the Estate of A B, deceased.\n\nor\n\nE F, Attorney for Personal Representative\n\nDated ________________, 19__.\n\nProvided, that in all proceedings wherein the decedent has been\n\ndead for a period of more than five (5) years prior to the\n\ncommencement of a probate proceeding for said decedent's estate, or\n\nwhere regular proceedings have been dispensed with pursuant to\n\nSection 241 of this title, the presentment date may be stated to be\n\na date certain (subject to the above provisions regarding the\n\nstating of the presentment date as a Saturday, Sunday, or legal\n\nholiday) which is at least one (1) month following the date said\n\nnotice is filed with the district court clerk for the county in\n\nwhich the probate is pending, and the first publication of said\n\nnotice shall appear on or before the tenth day after the filing of\n\nsaid notice with said district court clerk.","path":["OK Code","Title 58"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os58.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"6ed991c238f7df9d0d6148db35bbf2c589e02b1e6693ed44d4c3b6eb78f99f80","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-58-58-33","next":"us-ok/okla.-stat.-tit.-58-58-331.1"},"notice":"GroundRules: Original legal text.
