Stat. tit. 58, § 58-333","heading":"Bar of claims not presented in time - Exceptions","body":"All claims arising upon contracts entered into prior to the\n\ndecedent's death, whether the same be due, not due or contingent,\n\nmust be presented on or before the presentment date as provided in\n\nthe notice, and any claim not so presented is barred forever;\n\nprovided, however, that when it is made to appear by the affidavit\n\nof the claimant, to the satisfaction of the personal representative\n\nand the judge of the district court, as duly noted on the claim,\n\nthat the claimant had no notice by reason of being out of the state\n\nand that a copy of the notice to creditors was not mailed to said\n\nclaimant, the claim may be presented at any time before a final\n\ndecree of distribution is entered; provided, further, that nothing\n\nin this section, nor in this chapter contained, shall be construed\n\nto prohibit the right or limit the time of foreclosure of mortgages\n\nupon real property of decedents, but every such mortgage may be\n\nforeclosed within the time and in the mode prescribed in civil\n\nprocedure, except that no balance of the debt secured by such\n\nmortgage remaining unpaid after foreclosure shall be a claim against\n\nthe estate, unless such debt was presented as required by this code.","path":["OK Code","Title 58"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os58.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"ecdc5bf37eeaffcb35ec2a684d4de8e6748a5d62c99627bd90ceec412a4b7dea","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-58-58-332","next":"us-ok/okla.-stat.-tit.-58-58-334"},"notice":"GroundRules: Original legal text.
