When a claim is presented to the personal representative,\n\nthe personal representative must endorse thereon allowance or\n\nrejection, with the date thereof. If the personal representative\n\nallows the claim, it must be presented, with the date of such\n\npresentment noted thereon to the judge for approval by the judge,\n\nwho must, in the same manner, endorse upon it allowance or\n\nrejection.\n\nB. If the personal representative rejects the claim, in whole\n\nor in part, the personal representative shall mail a notice of such\n\nrejection to the creditor, by regular, first-class mail, to the\n\ncreditor's address last-known to the personal representative, not\n\nlater than five (5) days following the date of such partial or total\n\nrejection.\n\nC. 1. If the personal representative refuses or neglects to\n\nendorse such allowance or rejection for thirty (30) days after the\n\nclaim has been presented to him, such refusal or neglect is\n\nequivalent to a rejection on the thirtieth day after presentment of\n\nthe claim to the personal representative, regardless of the date on\n\nwhich the claim may have been actually rejected in whole or in part.\n\n2. If the judge refuses or neglects to endorse allowance or\n\nrejection on a claim, allowed by the personal representative, within\n\nthirty (30) days after the claim is presented to the judge, such\n\nrefusal or neglect is equivalent to a rejection on the thirtieth day\n\nafter presentment of the claim to the judge.\n\nD. If the claim be presented to the personal representative\n\nbefore the expiration of the time limited for the presentation of\n\nclaims, the same is presented in time, though acted upon by the\n\npersonal representative and/or by the judge after the expiration of\n\nsuch time.\n\nE. A claim presented to the personal representative at the\n\npersonal representative's place of residence or business or at the\n\npersonal representative's attorney's place of business prior to\n\nfirst publication of the notice shall be considered validly\n\npresented, shall be deemed to have been presented on the date of\n\nfirst publication of the notice and shall not be acted upon by the\n\npersonal representative prior to such date, and the personal\n\nrepresentative shall not be required to give notice to such creditor\n\nby mail, other than notice of rejection if the claim is rejected in\n\nwhole or in part to the creditor who presented such claim.\n\nF. For estate proceedings commenced after October 31, 2008, the\n\nfollowing provisions shall apply:\n\n1. If the personal representative rejects a claim, in whole or\n\nin part, but refuses or neglects to mail a notice of the rejection\n\nnot later than five (5) days following the date of partial or total\n\nrejection as required in paragraph B of this section, the forty-\n\nfive-day time period for limitation of actions as specified in\n\nSection 339 of this title shall not begin until the personal\n\nrepresentative has mailed notice of rejection to the creditor by\n\nregular, first-class mail to the creditor’s last-known address. In\n\nno event shall such limitation extend past the date that a petition\n\nfor final accounting is filed; and\n\n2. If the treatment of any claim by the personal representative\n\nor judge is deemed equivalent to a rejection, as described in\n\nparagraph 1 or 2 of subsection C of this section, the forty-five-day\n\ntime period for limitation of actions specified in Section 339 of\n\nthis title shall not begin until the personal representative has\n\nmailed notice of the deemed rejection to the creditor by regular,\n\nfirst-class mail to the creditor’s last-known address. In no event\n\nshall such limitation extend past the date that a petition for final\n\naccounting is filed.\n\nR.L. 1910, § 6342.
