Stat. tit. 58, § 58-385.1","heading":"Verified petition by guardian - Contents - Limitations","body":"To obtain an order for mortgaging such real estate for the\n\npurpose and under the provisions hereof, the guardian must present a\n\nverified petition to the district court or to the judge thereof,\n\nsetting forth a description of the property, real and personal, on\n\nhand and undisposed of, the legally established lien or the\n\nobligation which may by operation of law become a lien; the amount\n\nof the lien or the amount of the obligation which may by operation\n\nof law become a lien, the names and addresses of all parties\n\ninterested in the estate of the minor, incompetent or mentally ill\n\nperson, and the specific reasons why it will be to the best interest\n\nof the said estate to mortgage, rather than sell such real estate,\n\nor a part thereof.\n\nSuch authority shall not be given or order made therefor, and no\n\nmortgage on any real estate shall be made, given, executed or\n\ndelivered under the provisions hereof, for an amount in excess of\n\ntwo-thirds (2/3) of the appraised value thereof, as established by\n\nan appraisal made by three disinterested citizens of the county\n\nwithin one (1) year of the time of making such order to mortgage.","path":["OK Code","Title 58"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os58.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"33afaa9247a4c317df59e20c31e8633e06f00c65f3bccfb371f5434f02915c35","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-58-58-385","next":"us-ok/okla.-stat.-tit.-58-58-385.2"},"notice":"GroundRules: Original legal text.
