Stat. tit. 58, § 58-385a","heading":"Borrowing money - Mortgage of estate realty - Grant of","body":"authority by district court.\n\nIn addition to the grounds and reasons now set forth and\n\nprovided by law for which the district court may grant authority to\n\nadministrators or executors of the estates of deceased persons to\n\nmortgage, by contract, renewal or new mortgage, the real estate of\n\nsuch estates, the district court may, upon verified petition\n\nsupported by sufficient evidence showing that the best interest of\n\nthe owners of the real estate belonging to any such estate requires\n\nit, by an Order, grant authority to such administrators or executors\n\nto mortgage the real estate, or any part thereof, except the\n\nhomestead, belonging to an estate of a deceased person for the\n\npurpose of borrowing or securing money and funds with which to pay\n\noff and discharge outstanding and unpaid debts against the estate of\n\nsuch deceased persons, legally ordered and unpaid family allowance\n\nand expenses and charges of administration, whether said property\n\nhas or has not before that time been mortgaged by the decedent or by\n\nthe administrator or executor of his estate.","path":["OK Code","Title 58"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os58.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"b12516b891eb42f7383485ce74f710ccb90177e551f898dcdda6bec4cbef893c","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-58-58-385.3","next":"us-ok/okla.-stat.-tit.-58-58-385b"},"notice":"GroundRules: Original legal text.
