Stat. tit. 58, § 58-385b","heading":"Petition - Contents - Time for filing - Limitations","body":"To obtain an order for mortgaging such real estate for the\n\npurpose and under the provisions hereof, the administrator or\n\nexecutor must present a verified petition to the district court, or\n\nto the judge thereof, setting forth a description of the property,\n\nreal and personal, on hand and undisposed of, the legally\n\nestablished debts outstanding and unpaid, the legally ordered family\n\nallowance due and unpaid, if any, the amount of the charges and\n\nexpenses of administration, the names and addresses of the heirs,\n\ndevisees and legatees of the decedent, and the specific reason why\n\nit will be to the best interest of said estate to mortgage, rather\n\nthan to sell, such real estate or a part thereof. Such petition to\n\nmortgage shall not be filed and the authority therefor shall not be\n\ngiven or order therefor made, until after the time within which to\n\npresent claims has expired. Such authority shall not be given or\n\norder made therefor, and no mortgage on any real estate shall be\n\nmade, given, executed or delivered under the provisions hereof, for\n\nan amount in excess of two-thirds (2/3) of the appraised value\n\nthereof, as established by an appraisal made by three disinterested\n\ncitizens of the county within one (1) year of the time of making\n\nsuch order to mortgage.","path":["OK Code","Title 58"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os58.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"654a7df8034008bbbebb7820ddf7c6118c63c84413760df9f0d9953309a1b9a4","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-58-58-385a","next":"us-ok/okla.-stat.-tit.-58-58-385c"},"notice":"GroundRules: Original legal text.
