Stat. tit. 58, § 58-41","heading":"Proceedings on contest","body":"If anyone appears to contest the will, he must file written\n\ngrounds of opposition to the probate thereof, and serve a copy on\n\nthe petitioner and other residents of the county interested in the\n\nestate, any one or more of whom may demur thereto upon any of the\n\ngrounds of demurrer allowed by law in civil actions. If the\n\ndemurrer be sustained, the court must allow the contestant a\n\nreasonable time, not exceeding ten (10) days, within which to amend\n\nhis written opposition. If the demurrer is overruled, the\n\npetitioner and others interested may jointly or separately answer\n\nthe contestant's grounds, traversing or otherwise obviating or\n\navoiding the objections. Any issues of fact thus raised, involving:\n\n1. The competency of the decedent to make a last will and\n\ntestament.\n\n2. The freedom of the decedent at the time of the execution of\n\nthe will from duress, menace, fraud, or undue influence.\n\n3. The due execution and attestation of the will by the\n\ndecedent or subscribing witnesses; or,\n\n4.
