Stat. tit. 58, § 58-485","heading":"Sale of land subject to mortgage","body":"When any sale is made by an executor or administrator, pursuant\n\nto the provisions of this chapter, of lands subject to any mortgage\n\nor other lien, which is a valid claim against the estate of the\n\ndecedent and has been presented and allowed, the purchase money must\n\nbe applied, after paying the necessary expenses of the sale, first\n\nto the payment and satisfaction of the mortgage or lien, and the\n\nresidue, if any, in due course of administration. The application\n\nof the purchase money to the satisfaction of the mortgage or lien\n\nmust be made without delay; and the land is subject to such mortgage\n\nor lien until the purchase money has been actually so applied. No\n\nclaim against any estate which has been presented and allowed is\n\naffected by the statute of limitations, pending the proceedings for\n\nthe settlement of the estate. The purchase money, or so much\n\nthereof as may be sufficient to pay such mortgage or lien, with\n\ninterest, and any lawful costs and charges thereon, may be paid into\n\nthe district court, to be received by the judge thereof, whereupon\n\nthe mortgage or lien upon the land must cease, and the purchase\n\nmoney must be paid over by the judge without delay, in payment of\n\nthe expenses of the sale and in satisfaction of the debt, to secure\n\nwhich the mortgage or other lien was taken, and the surplus, if any,\n\nat once returned to the executor or administrator, unless, for good\n\ncause shown, after notice to the executor or administrator, the\n\njudge otherwise directs.","path":["OK Code","Title 58"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os58.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"fe600fb336d2ea5eecad3d1eb6fb9c0d4a16518b7c713c87746eae1fc45268a8","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-58-58-484","next":"us-ok/okla.-stat.-tit.-58-58-486"},"notice":"GroundRules: Original legal text.
