Stat. tit. 58, § 58-5","heading":"Venue of probate acts","body":"The district court in and for the county of proper venue has\n\nexclusive jurisdiction to prove a will or to grant letters\n\ntestamentary or of administration. Proper venue for hearing in such\n\nactions shall be determined as follows:\n\n1. If the decedent died as a resident of this state, in the\n\ncounty of which the decedent was a resident at the time of his or\n\nher death, regardless of where the decedent died;\n\n2. If the decedent died while not a resident of this state:\n\na. first, in the county of this state in which the\n\ndecedent died, leaving an estate therein,\n\nb. second, in any county of this state in which any part\n\nof the estate of the deceased may be, where the\n\ndecedent\n\n(1) died out of this state, or\n\n(2) died within this state but did not leave an\n\nestate in the county in which the decedent died,\n\nand\n\nc. third, in the county in which the decedent died,\n\nleaving no estate in this state; or\n\n3. In all cases of administration of estates of deceased\n\npersons in this state where final decrees have been entered prior to\n\nthe effective date of this act, and for which the final decrees are\n\nor may be defective or invalid for lack of jurisdiction because the\n\nadministration was in a county other than the county of proper venue\n\nas prescribed by this section, such final decrees shall be deemed\n\nvalid; provided, however, the provisions of this paragraph:\n\na. shall not apply to any case where an action is\n\ninstituted and maintained to modify or vacate the\n\nfinal decree within one (1) year of the effective date\n\nof this act, and\n\nb. shall not bar the claim of a person claiming an\n\ninterest in a decedent's estate if the person did not\n\nreceive notice of the probate or estate\n\nadministration, actual or constructive, as required by\n\nthis title.","path":["OK Code","Title 58"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os58.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"0f26976c3dd32ee279aac0659e1d27776b34aa14f68221a435e7411d28e90e67","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-58-58-499","next":"us-ok/okla.-stat.-tit.-58-58-501"},"notice":"GroundRules: Original legal text.
