Stat. tit. 58, § 58-591","heading":"Order of payment of debts","body":"The debts of the estate must be paid in the following order:\n\n1. Funeral expenses.\n\n2. The expenses of the last sickness.\n\n3. Funds necessary for the support of the family and allowed by\n\nthe court pursuant to the provisions of this chapter.\n\n4. Taxes to the United States or the state, county, or city.\n\n5. Debts having preference under the laws of the United States\n\nand of this state.\n\n6. Judgments rendered against the decedent in his lifetime,\n\nwhich are liens upon his property and mortgages in the order of\n\ntheir date.\n\n7. Demands or claims which are presented to the executor or\n\nadministrator for an allowance or proved within two (2) months after\n\nthe first publication of notice to creditors.\n\n8. All other demands against the estate except those set forth\n\nin paragraph 9 of this section.\n\n9. Interest resulting from the extension of time for payment of\n\nfederal estate or transfer taxes.
