Stat. tit. 58, § 58-625","heading":"Assessment against legatee or devisee","body":"When any bond has been executed and delivered, under the\n\nprovisions of the preceding section, and it is necessary for the\n\nsettlement of the estate to require the payment of any part of the\n\nmoney thereby secured, the executor or administrator must petition\n\nthe court for an order requiring the payment, and have a citation\n\nissued and served on the party bound, requiring him to appear and\n\nshow cause why the order should not be made. At the hearing, the\n\ncourt, if satisfied of the necessity of such payment, must make an\n\norder accordingly, designating the amount and giving a time within\n\nwhich it must be paid.
