Stat. tit. 58, § 58-710","heading":"Attorney appointed by the court, when","body":"At or before the hearing of petitions and contests for the\n\nprobate of wills; for letters testamentary or of the administration;\n\nfor sales of real estate and confirmation thereof; settlements,\n\npartitions and distributions of estates; and all other proceedings\n\nwhere all the parties interested in the estate are required to be\n\nnotified thereof, the court may, in its discretion, appoint some\n\ncompetent attorney-at-law to represent in all such proceedings the\n\ndevisees, legatees, heirs, or creditors of the decedent, who are\n\nminors and have no general guardian in the county, or who are\n\nnonresidents of the state, and those interested, who, though they\n\nare neither such minors or nonresidents, are unrepresented. The\n\norder must specify the names of the parties for whom the attorney is\n\nappointed, who is thereby authorized to represent such parties in\n\nall such proceedings had subsequent to his appointment. The\n\nattorney may receive a fee to be fixed by the court for his\n\nservices, which must be paid out of the funds of the estate as\n\nnecessary expenses of administration, and upon distribution may be\n\ncharged to the party represented by the attorney. If for any cause\n\nit becomes necessary, the district court may substitute another\n\nattorney for the one first appointed, in which case the fee must be\n\nproportionately divided.
