Stat. tit. 58, § 58-8","heading":"Transfer of old matters authorized","body":"When it is made to appear that any probate matter pending in any\n\ncourt of this state which, by acts of Congress and the Constitution,\n\nwas transferred from the courts of the Territory of Oklahoma and the\n\nUnited States courts in the Indian Territory to the courts of this\n\nstate, is not in the county where the venue of such suit, matter or\n\nproceeding would lie if arising after the admission of this state\n\ninto the Union, the court where such suit, matter or proceeding is\n\npending shall, upon the application of the guardian, executor or\n\nadministrator, or any other person having a substantial interest\n\ntherein, or upon its own motion, when a proper showing has been made\n\nfor a removal, within twenty (20) days after application is made\n\ntherefor, make an order transferring such suit, matter or proceeding\n\nto the county where the venue would properly lie if such suit,\n\nmatter or proceeding had arisen since the admission of this state\n\ninto the Union, by transmitting to such county the original papers,\n\ntogether with certified copies of all orders and judgments, upon the\n\npayment of all accrued costs: Provided, that where any minor is the\n\nowner of an estate situate in a county or in counties other than\n\nthat of his domicile and a guardian or curator has heretofore been\n\nappointed for such minor or his estate in any such county other than\n\nthat of the domicile of such minor, such suit, matter or proceedings\n\nshall be transferred in the manner and upon the conditions herein\n\nprovided, to the county of the domicile of such minor; And provided,\n\nfurther, that such original papers, together with such certified\n\ncopies of all orders and judgments, shall be filed in the court to\n\nwhich such matter is removed, and the same shall proceed as if\n\nordinarily filed therein, without further service of notice.","path":["OK Code","Title 58"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os58.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a9dfa97e98db1014135a37e307e30d2953a9ba7a7c298b402f89bf8eb097273d","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-58-58-741","next":"us-ok/okla.-stat.-tit.-58-58-81"},"notice":"GroundRules: Original legal text.
