Stat. tit. 58, § 58-962","heading":"Setting for hearing - Notice - Finding - Order","body":"Upon the filing of such petition the district court in which\n\nsaid estate of said decedent, minor or incompetent person is being\n\nadministered shall set the matter for hearing not less than four (4)\n\nweeks after the date of filing said petition, and notice thereof\n\nshall be given to the heirs, devisees and legatees of said decedent,\n\nor the next of kin of said minor or incompetent person, whose names\n\nand addresses are known, by mail not less than twenty (20) days\n\nprior to said hearing, and by publication for not less than three\n\n(3) consecutive weeks prior to such hearing as to heirs, devisees\n\nand legatees of said deceased person, or the next of kin of said\n\nminor or incompetent person whose names and addresses be not known.\n\nIf the court shall find upon hearing that it is necessary for\n\nthe preservation of the value of said property, or its rental value,\n\nto lease said property, the court shall direct that the\n\nadministrator, administrator with will annexed or executor of such\n\ndeceased person, or the guardian of such minor or incompetent person\n\nshall advertise that said property will be leased on the best terms\n\navailable, subject to confirmation by court, and that said proposed\n\nlease or leases shall be presented to the court at the date therein\n\nfixed, not less than four (4) weeks following the date of said\n\norder, and notice of said proposed leasing shall be given by\n\npublication for not less than three (3) consecutive weeks and by\n\nmailing a copy of such notice to the heirs, devisees and legatees of\n\nsuch deceased person, or the next of kin of such minor incompetent\n\nperson, whose names and addresses are known, not less than twenty\n\n(20) days prior to the date fixed.","path":["OK Code","Title 58"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os58.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"24b0f0442449be182da4f4b61e7e62cd04b1cf21483f8f7854a1e1ed4859d046","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-58-58-961","next":"us-ok/okla.-stat.-tit.-58-58-963"},"notice":"GroundRules: Original legal text.
