Stat. tit. 58, § 58-963","heading":"Presentation of proposed lease to court - Review by court","body":"- Approval - Bond.\n\nOn the date fixed in the notice in the last preceding section,\n\nif a proposed lease, or leases, shall have been presented to the\n\nadministrator, administrator with will annexed, executor, or\n\nguardian which shall meet with the approval of said administrator,\n\nadministrator with will annexed, executor or guardian he shall\n\npresent the same to the district court administering the estate of\n\nsaid decedent or minor or incompetent person, and on said date the\n\ndistrict court shall review the said proposed lease or leases which\n\nshall have been approved by said administrator, administrator with\n\nwill annexed, executor or guardian, and any objections interposed\n\nthereto, and shall ascertain whether it shall be to the best\n\ninterest of the estate of said deceased person, minor or incompetent\n\nto enter into said proposed lease, or any of said proposed leases,\n\nand, if it shall be to the best interest of the estate of said\n\ndeceased person, minor or incompetent person shall approve that one\n\nwhich shall in the opinion of said district court be most\n\nadvantageous to the estate of said deceased person, or minor or\n\nincompetent person. The court shall direct the administrator,\n\nadministrator with will annexed, executor or guardian to execute the\n\nlease upon there being furnished to him a bond, conditioned for\n\nfaithful performance of said lease by the lessee, in a sum equal to\n\none-fifth (1/5) of the total rental to be paid under said lease, or\n\nthe rental for two (2) years, or the value of the improvements\n\nagreed to be placed upon said leased property by the lessee,\n\nwhichever is the greater.
