Stat. tit. 59, § 59-1000.23","heading":"Power and duty to review and adopt codes and standards","body":"— Continuing education and certification process for construction\n\nindustry personnel.\n\nA. The Oklahoma Uniform Building Code Commission shall have the\n\npower and the duty to review and adopt all codes and standards for\n\nresidential and commercial construction to be used by all entities\n\nwithin this state. Codes and standards adopted by the Commission\n\nshall be the minimum standards for residential and commercial\n\nconstruction in this state.\n\nB. All public projects shall abide by such minimum standards\n\nand requirements; provided, nothing in the Oklahoma Uniform Building\n\nCode Commission Act shall prevent or take away from state agencies\n\nthe authority to enact and enforce requirements containing higher\n\nstandards and requirements than such minimum standards and\n\nrequirements.\n\nC. Municipalities and other political subdivisions shall abide\n\nby such minimum standards and requirements; provided, nothing in the\n\nOklahoma Uniform Building Code Commission Act shall prevent or take\n\naway from such municipalities and other political subdivisions the\n\nauthority to enact and enforce requirements containing higher\n\nstandards and requirements than such minimum standards and\n\nrequirements.\n\nD. The Oklahoma Uniform Building Code Commission shall have the\n\npower and duty to establish a continuing education and training and\n\ncertification process for all residential and commercial\n\nconstruction industry personnel affected by the codes adopted by the\n\nCommission, including, but not limited to, code officials, design\n\nprofessionals, and trade workers. The regional training shall be\n\noffered at no cost to state-licensed building code officials and\n\nshall be funded from the funds received pursuant to Section 1000.25\n\nof this title. A fee may be assessed to all participants other than\n\nstate-licensed code officials. When assessed, the fee shall be\n\nlimited to any cost directly associated with the training and shall\n\nbe remitted to the State Treasury pursuant to the Oklahoma Uniform\n\nBuilding Code Commission Act. Such fees shall be deposited in the\n\nOklahoma Uniform Building Code Commission Revolving Fund and shall\n\nbe used solely for the purposes of the Oklahoma Uniform Building\n\nCode Commission Act. Each code official operating in this state on\n\nbehalf of any state agency or any municipal or county office may\n\ncomplete regional training and be issued a certificate of completion\n\nby the Oklahoma Uniform Building Code Commission. The training and\n\ncertification applications, qualifications and procedures shall be\n\npromulgated by rules of the Commission. The Commission may\n\nestablish forms and procedures to implement and administer the\n\nprovisions of this section.\n\nE. The Commission shall establish a workforce development\n\nprocess with the purpose of increasing the number of available code\n\nofficials in Oklahoma.
