Beginning July 1, 2009, pursuant to and in compliance\n\nwith Article I of the Administrative Procedures Act, the Oklahoma\n\nUniform Building Code Commission shall have the power to adopt,\n\namend, repeal and promulgate rules as may be necessary to perform\n\nthe duties required under the Oklahoma Uniform Building Code\n\nCommission Act. Rules authorized under this section shall not\n\nbecome effective prior to October 1, 2009.\n\n2. Beginning October 1, 2009, the Commission shall have the\n\npower to enforce the provisions of the Oklahoma Uniform Building\n\nCode Commission Act.\n\n3. Any codes adopted by state agencies, municipalities or other\n\npolitical subdivisions of the state prior to uniform codes being\n\nadopted by the Oklahoma Uniform Building Code Commission, pursuant\n\nto the provisions of, or rules promulgated pursuant to, the Oklahoma\n\nUniform Building Code Commission Act, shall be considered valid and\n\nin effect until uniform codes are adopted by the Oklahoma Uniform\n\nBuilding Code Commission.\n\nB. The Oklahoma Uniform Building Code Commission shall have the\n\nfollowing powers:\n\n1. Exercise all incidental powers and duties which are\n\nnecessary to effectuate the provisions of the Oklahoma Uniform\n\nBuilding Code Commission Act;\n\n2. Adopt and have an official seal;\n\n3. Maintain an administrative staff, including, but not limited\n\nto, an Oklahoma Uniform Building Code Commission Chief Executive\n\nOfficer;\n\n4. Direct such other expenditures as may be necessary in the\n\nperformance of its duties, including, but not limited to,\n\nexpenditures for office space, equipment, furnishings and contracts\n\nfor services. All expenditures shall be made pursuant to the\n\nOklahoma Central Purchasing Act;\n\n5. Appoint technical committees to review and recommend for\n\nadoption all building codes. The technical committees shall review\n\nand recommend building codes with any amendments for adoption by the\n\nCommission; and\n\n6. Create a website listing all building codes adopted by the\n\nCommission. The website shall provide a method for listing all\n\ncodes adopted by a state agency, city or any other political\n\nsubdivision of the state containing higher standards and\n\nrequirements than the codes adopted pursuant to the Oklahoma Uniform\n\nBuilding Code Commission Act as required in Section 14-107 of Title\n\n11 of the Oklahoma Statutes.\n\nC. After October 1, 2009, the Commission shall account for all\n\nreceipts and expenditures of the monies of the Commission, including\n\nannually preparing and publishing a statement of receipts and\n\nexpenditures of the Commission for each fiscal year. The\n\nCommission's annual statement of receipts and expenditures shall be\n\naudited by the State Auditor and Inspector or an independent\n\naccounting firm, and the audit report shall be certified to the\n\nGovernor of this state to be true and correct, under oath, by the\n\nchair and vice-chair of the Commission.\n\nD.
