The Oklahoma Uniform Building Code Commission shall\n\nestablish a system of fees to be charged for the issuance and\n\nrenewal of any construction permits issued by any agency,\n\nmunicipality, or other political subdivision of this state.\n\nB. This provision is subject to the following limitations:\n\n1. No schedule of fees may be established or amended by the\n\nCommission except during such times as the Legislature is in\n\nsession; provided, the Commission may establish or amend a schedule\n\nof fees at a time when the Legislature is not in session if the fees\n\nor schedule of fees has been specifically authorized by the\n\nLegislature pursuant to paragraphs 3 and 4 of this subsection. The\n\nCommission must follow the procedures required by Article I of the\n\nAdministrative Procedures Act for adoption of rules in establishing\n\nor amending any such schedule of fees;\n\n2. The Commission shall charge fees for construction permits\n\nand renewal of such permits issued by any state agency,\n\nmunicipality, or other political subdivision of this state which\n\nauthorized work governed by codes within the purview of the\n\nCommission only within the following ranges:\n\na. for issuance of permit not to exceed $5.00\n\nb. for renewal of permit not to exceed $5.00\n\n3. Fees shall be remitted to the Oklahoma Uniform Building Code\n\nCommission within thirty (30) days after the end of the preceding\n\ncalendar month. The Oklahoma Uniform Building Code Commission shall\n\nreport electronically to the Governor, President Pro Tempore of the\n\nSenate and the Speaker of the House semiannually its collections for\n\nthe six (6) months preceding the report;\n\n4. Fees shall be collected by any state agency, municipality or\n\nother political subdivision issuing construction permits within this\n\nstate. The fees shall be deposited in an account created by the\n\ncollecting entity for that purpose;\n\n5. The state agency, municipality or other political\n\nsubdivision shall remit the monies in the account on a monthly basis\n\ndirectly to the State Treasury for deposit in the Oklahoma Uniform\n\nBuilding Code Commission Revolving Fund created pursuant to Section\n\n1000.28 of this title. Along with the deposits required by this\n\nparagraph, each state agency, municipality or other political\n\nsubdivision shall also submit a report stating the total amount of\n\nfunds collected and the total number of fees imposed during the\n\npreceding month. The report shall be made on computerized or manual\n\ndisposition reports as provided by rule of the Commission;\n\n6. Any state agency, municipality or other political\n\nsubdivision collecting and remitting fees pursuant to this section\n\nmay levy a fee up to fifty cents ($0.50) for every construction\n\npermit or renewal permit issued. These monies shall be deposited\n\ninto an account for the sole use of the state agency, municipality\n\nor other political subdivision. The state agency, municipality or\n\nother political subdivision shall state the total amount of funds\n\ncollected and the total number of fees imposed to the State Treasury\n\nin the report required by paragraph 5 of this subsection;\n\n7. It shall be the responsibility of the state agency,\n\nmunicipality or other political subdivision to account for and\n\nensure the correctness and accuracy of payments made to the State\n\nTreasury pursuant to this title;\n\n8. Funds collected by a state agency, municipality or other\n\npolitical subdivision and remitted to the State Treasury pursuant to\n\nthe Oklahoma Uniform Building Code Commission Act shall be deposited\n\nin the Oklahoma Uniform Building Code Commission Revolving Fund and\n\nshall be used solely for the purposes of the Oklahoma Uniform\n\nBuilding Code Commission Act; and\n\n9.
