Stat. tit. 59, § 59-1000.4a","heading":"Additional powers - Skilled Trade Education and","body":"Workforce Development Fund.\n\nA. The Construction Industries Board shall have the additional\n\npowers to:\n\n1. Receive and convey information relating to the skilled\n\ntrades regulated by the Construction Industries Board including, but\n\nnot limited to, workforce development; and\n\n2. Enter into contracts with the Oklahoma Department of Career\n\nand Technology Education, any Oklahoma State Board of Career and\n\nTechnology Education fully accredited vocational or technical\n\nschool, or any accredited system of education institution in this\n\nstate receiving state appropriations and offering programs in\n\nsecondary or postsecondary instruction that provide electrical,\n\nmechanical, plumbing or roofing trade coursework for any of the\n\nfollowing purposes, or combination thereof:\n\na. developing and implementing instructional courses on\n\nOklahoma Statutes and rules that govern the\n\nelectrical, mechanical, plumbing and roofing trades,\n\nwhich courses can be in conjunction with instruction\n\nin performing trade work or instruction on statewide-\n\nadopted trade codes, or both, for the advancement of\n\nthe electrical, mechanical, plumbing and roofing\n\ntrades, or\n\nb. developing and implementing a workforce development\n\nprogram that will create interest in the pursuit of a\n\nskilled trade career. The workforce development\n\nprogram may consist of, but shall not be limited to,\n\nuse of the Internet, community and school\n\npresentations, research and instruction on the\n\nelectrical, mechanical, plumbing and roofing trades,\n\nand may be implemented through public awareness and\n\npublic information campaigns to promote skilled trades\n\nand skilled trade careers as provided in this section.\n\nB. All contracts pursuant to this section shall be approved by\n\nthe Construction Industries Board in accordance with the Oklahoma\n\nOpen Meeting Act. Costs of the contracts for education and\n\nworkforce development programs shall be paid from the Skilled Trade\n\nEducation and Workforce Development Fund created in subsection E of\n\nthis section and funded by administrative fines or penalties as\n\ndescribed in this section. Applications for proposals are to be\n\nsubmitted to the Board on forms provided requiring sufficient\n\njustification and information to evaluate costs, return on\n\ninvestment, value, and viability of the proposal. Any contracts\n\nwill include the requirement that the recipient of the funds will,\n\nupon the completion of the contract, provide a written report to the\n\nBoard providing an accounting of expenditures, describing an\n\nexplanation of the funds used for the services provided and the\n\nsuccess of outreach demonstrating a return on the investment\n\nincluding, but not limited to, an accounting of accomplishments.\n\nC. Fines or penalties collected by the Board and deposited in\n\nthe Oklahoma Mechanical Licensing Revolving Fund, the Electrical\n\nRevolving Fund, the Plumbing Licensing Revolving Fund and the\n\nRoofing Contractor Registration Revolving Fund may be transferred to\n\nthe Skilled Trade Education and Workforce Development Fund created\n\nin subsection E of this section for the following purposes:\n\n1. To develop instructional materials on Oklahoma laws,\n\nstatutes and rules, as they relate to the plumbing, mechanical,\n\nelectrical and roofing trades and state licensing standards;\n\n2. To cover the cost of equipment, materials, personnel and any\n\nother costs of developing and implementing the trade curriculum; and\n\n3. To cover the cost of equipment, materials, personnel and any\n\nother costs of developing and implementing the workforce development\n\nprogram used to promote the plumbing, mechanical, electrical and\n\nroofing trades as a career in Oklahoma.\n\nD. The Skilled Trade Education and Workforce Development Fund\n\nmonies shall be used only for the advancement of trade-related\n\neducation and workforce development, and only if available based\n\nupon statutory limitations.\ny\n\nother costs of developing and implementing the workforce development\n\nprogram used to promote the plumbing, mechanical, electrical and\n\nroofing trades as a career in Oklahoma.\n\nD. The Skilled Trade Education and Workforce Development Fund\n\nmonies shall be used only for the advancement of trade-related\n\neducation and workforce development, and only if available based\n\nupon statutory limitations.\n\nE. 1. There is hereby created in the State Treasury a\n\nrevolving fund for the Construction Industries Board to be\n\ndesignated the \"Skilled Trade Education and Workforce Development\n\nFund\". The fund shall be a continuing fund, not subject to fiscal\n\nyear limitations. The fund shall consist of an annual transfer of\n\nfully adjudicated fine revenue received in the Oklahoma Mechanical\n\nLicensing Revolving Fund, Electrical Revolving Fund, Plumbing\n\nLicensing Revolving Fund or Roofing Contractor Registration\n\nRevolving Fund as determined pursuant to this section. Funds may be\n\ntransferred only from the prior fiscal year.\n\n2. If actual receipts, not including fine receipts, exceed\n\nactual expenses and outstanding encumbrances, then one hundred\n\npercent (100%) of all fully adjudicated fine revenue received shall\n\nbe transferred from each specific trade revolving fund: the\n\nOklahoma Mechanical Licensing Revolving Fund, Electrical Revolving\n\nFund, Plumbing Licensing Revolving Fund or Roofing Contractor\n\nRegistration Revolving Fund.\n\n3. If at any time the receipts in the Oklahoma Mechanical\n\nLicensing Revolving Fund, Electrical Revolving Fund, Plumbing\n\nLicensing Revolving Fund or Roofing Contractor Registration\n\nRevolving Fund, not including fine receipts, are less than actual\n\nexpenses and outstanding encumbrances, then the difference of fine\n\nreceipts over actual expenses and outstanding encumbrances, if any,\n\nshall be transferred.\n\n4. If at any time the annual receipts in the Oklahoma\n\nMechanical Licensing Revolving Fund, Electrical Revolving Fund,\n\nPlumbing Licensing Revolving Fund or Roofing Contractor Registration\n\nRevolving Fund, including fine receipts, are less than the actual\n\nexpenses and outstanding encumbrances, there shall be no transfer of\n\nfunds for that period.\n\n5. All monies accruing to the credit of the Skilled Trade\n\nEducation and Workforce Development Fund may be budgeted and\n\nexpended by the Construction Industries Board for workforce\n\ndevelopment as it relates to the skilled trades and to contract for\n\nthe services identified in this act. Expenditures from the fund\n\nshall be made upon warrants issued by the State Treasurer against\n\nclaims filed as prescribed by law with the Director of the Office of\n\nManagement and Enterprise Services for approval and payment.\n\n6. All unexpended or outstanding Skilled Trade Education and\n\nWorkforce Development Funds from any written agreement where work or\n\nservices have not been previously approved by specific quote or cost\n\nestimate and have not been performed within eighteen (18) months of\n\nthe date the agreement was signed are hereby released from the\n\nagreement and are available for future agreements approved by the\n\nBoard pursuant to this act, except for specific quotes, estimates,\n\nor invoices that previously have been approved for payment,\n\nperformance has been initiated, and completed within twenty-four\n\n(24) months of the signed agreement.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"11fe108c6e106ad7b1085ede233bc69a526535d0f058d5dbe3172e1723c9610c","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-1000.4","next":"us-ok/okla.-stat.-tit.-59-59-1000.5"},"notice":"GroundRules: Original legal text.
