The Construction Industries Board may establish a system of\n\nfees by rule to be charged for the application for licenses, for the\n\nissuance and renewal of licenses and permits, for administration of\n\nexaminations, for formal project reviews and dishonored checks under\n\nthe Board's authority. This provision is subject to the following\n\nlimitations:\n\n1. No schedule of fees may be established or amended by the\n\nBoard except during such times as the Legislature is in session;\n\nprovided, the Board may establish or amend a schedule of fees at a\n\ntime when the Legislature is not in session if the fees or schedule\n\nof fees has been specifically authorized by the Legislature pursuant\n\nto paragraph 2 of this subsection. The Board must follow the\n\nprocedures required by Article I of the Administrative Procedures\n\nAct for adoption of rules in establishing or amending any such\n\nschedule of fees; and\n\n2. The Board shall charge fees only within the following\n\nranges, except as may be otherwise specified in this section or\n\nanother provision of law.\n\nFor application for license not to exceed $30.00\n\nFor administration of license\n\nexaminations: not to exceed $200.00\n\nFor license or permit issuance: not to exceed $300.00\n\nFor license or permit renewal: not to exceed $200.00\n\nFor formal project review for\n\ncode conformance: not to exceed $200.00\n\nFor permit issuance for the use\n\nof alternative materials or\n\nmethods: not to exceed $50.00\n\nFor dishonored checks: not to exceed amount\n\npursuant to the\n\nprovisions of Section\n\n1121 of Title 47 of the\n\nOklahoma Statutes.\n\nB. The Board shall base its schedule of fees upon the\n\nreasonable costs of review and inspection services rendered in\n\nconnection with each license, permit, or review, but shall be within\n\nthe ranges specified in paragraph 2 of subsection A of this section,\n\nexcept as otherwise specified in this section or provided by law.\n\nThe Board shall establish a system of training for all personnel who\n\nrender review and inspection services in order to assure uniform\n\nstatewide application of rules. The Board shall include the\n\nreasonable costs associated with such training in the fees provided\n\nfor in this section.\n\nC. The Board may exempt by rule any class of licensee or\n\npermittee from the requirements of the fee schedule if the Board\n\ndetermines that the creation of such a schedule for any such class\n\nwould create an unreasonable economic hardship.\n\nD. All fee changes adopted by the Board shall be reviewed and\n\napproved as provided in subsection F of Section 308 of Title 75 of\n\nthe Oklahoma Statutes.\n\nE. Unless otherwise provided, licenses and permits issued by\n\nthe Construction Industries Board shall be for a one-year period.\n\nF. When, at the time of application or renewal of any license\n\nor registration, payment is made by check for fees and the check is\n\nnot paid by the bank on which drawn for any reason, such license or\n\nregistration issued at that time shall be invalid. In all such\n\ncases, the license or registration shall be subject to the license\n\nor registration fees and penalties provided in subsection A of this\n\nsection and treated as though no attempt to apply for or renew a\n\nlicense or registration had been made.
