In addition to any other remedies provided for by law, the\n\nConstruction Industries Board may issue a written order to any\n\nperson or entity whom the Board has reason to believe is in\n\nviolation of, or has violated, any law which the Board has authority\n\nto enforce or the standards or rules promulgated by the Board, and\n\nto whom the Board has served, no less than fifteen (15) days\n\npreviously, a written notice of violation. The fifteen-day notice\n\nperiod may be reduced as, in the opinion of the Board, may be\n\nnecessary to render the order reasonably effectual.\n\nB. The written order may require immediate compliance with the\n\nlaw or the standards or rules promulgated by the Board, or within a\n\nspecified time period, or both. The order may also assess an\n\nadministrative fine for each day or part of a day that such person\n\nfails to comply with the order.\n\nC. Any order issued pursuant to this section shall state with\n\nspecificity the nature of the violation. Any penalty assessed in\n\nthe order shall not exceed One Thousand Dollars ($1,000.00) per day\n\nof noncompliance with the order. In assessing such penalty, the\n\nBoard shall consider the seriousness of the violation and any\n\nefforts to comply with applicable requirements.\n\nD. Any order issued pursuant to the provisions of this section\n\nshall become a final order unless, no later than fifteen (15) days\n\nafter the order is served, the person or persons named therein\n\nrequest an administrative hearing. Upon such request, the Board\n\nshall promptly conduct a hearing. The Board may dismiss such\n\nproceedings when compliance with the order is demonstrated and all\n\nassessed fines, whether negotiated or not, are paid. A final order\n\nfollowing a hearing determining a violation occurred shall assess an\n\nadministrative fine based upon consideration of the evidence and as\n\nallowed by law or rule.\n\nE.
