Stat. tit. 59, § 59-1010","heading":"Plumbing Hearing Board - Investigations and hearings -","body":"Suspensions - Jurisdiction of political subdivisions.\n\nA. The designee of the Construction Industries Board, as chair,\n\nand the members of the Oklahoma State Committee of Plumbing\n\nExaminers shall constitute a Plumbing Hearing Board, which may on\n\nits own motion make investigations and conduct hearings. The\n\nPlumbing Hearing Board may, on its own motion or upon complaint in\n\nwriting duly signed and verified by the complainant, and upon not\n\nless than ten (10) days' notice to the licensee, suspend any license\n\nor registration issued under The Plumbing License Law of 1955, and\n\nmay revoke such license or registration in the manner hereinafter\n\nprovided, if by clear and convincing evidence it finds that the\n\nholder of the license has:\n\n1. Made a material misstatement in the application for license\n\nor renewal thereof;\n\n2. Loaned or illegally used the license;\n\n3. Demonstrated incompetency to act as a journeyman plumber or\n\nplumbing contractor, as the case may be;\n\n4. Violated any provision of The Plumbing License Law of 1955,\n\nor any rule or order prescribed by the Construction Industries\n\nBoard, or any ordinance or regulation for the installation of\n\nplumbing made or enacted by a city, town, or sewer Board by\n\nauthority of The Plumbing License Law of 1955; or\n\n5. Willfully and unreasonably failed to perform his or her\n\nnormal business obligations without justifiable cause.\n\nB. A copy of the complaint with notice of the suspension of\n\nlicense, if ordered by the Plumbing Hearing Board, shall be served\n\non the person complained against, and the answer thereto shall be\n\nfiled in the time allowed for the filing of answers in legal\n\nproceedings by the statutes of this state.\n\nC. Any administrative hearing on suspensions, revocations or\n\nfines shall be conducted by a hearing examiner appointed by the\n\nConstruction Industries Board. The hearing examiner’s decision\n\nshall be a final decision which may be appealed to a district court\n\nin accordance with the Administrative Procedures Act.\n\nD. No order revoking a license shall be made until after a\n\npublic hearing, held in accordance with the provisions of Article II\n\nof the Administrative Procedures Act, by the Plumbing Hearing Board\n\nwhich shall not be less than thirty (30) days and not more than\n\nsixty (60) days after the date of notice of suspension. The hearing\n\nshall be held at the place designated by the Plumbing Hearing Board.\n\nThe person complained against shall have the right to be represented\n\nby counsel and to introduce any evidence in defense. The conduct of\n\nthe hearing shall be in accordance with recognized rules of legal\n\nprocedure and any member of the Plumbing Hearing Board or a\n\nrepresentative designated by the Plumbing Hearing Board shall have\n\nauthority to administer oaths and take testimony.\n\nE. Any person whose license or registration has been revoked\n\nmay, after the expiration of one (1) year from the date of such\n\nrevocation, but not before, apply for a new license.\n\nF. Notwithstanding any other provision of law, a political\n\nsubdivision of this state that has adopted a nationally recognized\n\nplumbing code and appointed an inspector pursuant to Section 1016 of\n\nthis title or pursuant to the Oklahoma Inspectors Act for such work\n\nshall have jurisdiction over the interpretation of the code and the\n\ninstallation of all plumbing work done in that political\n\nsubdivision, subject to the provisions of the Oklahoma Inspectors\n\nAct. Provided, a state inspector may work directly with a plumbing\n\ncontractor or journeyman plumber in such a locality if a violation\n\nof the code creates an immediate threat to life or health.\n\nG. In the case of a complaint about, investigation of, or\n\ninspection of any license, registration, permit or plumbing in any\n\npolitical subdivision of this state which has not adopted a\n\nwith a plumbing\n\ncontractor or journeyman plumber in such a locality if a violation\n\nof the code creates an immediate threat to life or health.\n\nG. In the case of a complaint about, investigation of, or\n\ninspection of any license, registration, permit or plumbing in any\n\npolitical subdivision of this state which has not adopted a\n\nnationally recognized plumbing code and appointed an inspector\n\npursuant to Section 1016 of this title or pursuant to the Oklahoma\n\nInspectors Act for such work, the Construction Industries Board\n\nshall have jurisdiction over such matters.\n\nH. 1. No individual, business, company, corporation, limited\n\nliability company, association or other entity subject to the\n\nprovisions of Section 1001 et seq. of this title shall install,\n\nmodify or alter plumbing in any incorporated area of this state\n\nwhich has not adopted a nationally recognized plumbing code and\n\nappointed an inspector pursuant to Section 1016 of this title or\n\npursuant to the Oklahoma Inspectors Act for such work without\n\nproviding notice of such plumbing to the Construction Industries\n\nBoard. A notice form for reproduction by an individual or entity\n\nrequired to make such notice shall be provided by the Construction\n\nIndustries Board upon request.\n\n2. Notice to the Construction Industries Board pursuant to this\n\nsubsection shall not be required for plumbing maintenance or\n\nreplacement of an existing plumbing device or fixture, unless such\n\ndevice is gas fired, or of any petroleum refinery or its research\n\nfacilities.\n\n3.
