For purposes of a building and construction inspector\n\nperforming functions normally performed by a building and\n\nconstruction inspector for a political subdivision pursuant to the\n\nOklahoma Inspectors Act, the Construction Industries Board shall\n\ncreate for one acting as or performing the work of a building and\n\nconstruction inspector a separate classification of inspector\n\nlicense to act as an authorized provider of a political subdivision,\n\nand such licensure shall be governed by the Oklahoma Inspectors Act\n\nand rules promulgated on the requirements of such licensure.\n\nB. As used in this section, \"authorized provider\" means one who\n\nis not a governmental employee but an independent contractor who is\n\nrecognized by a political subdivision that issues building permits\n\nand who meets the requirements under the Oklahoma Inspectors Act and\n\nrules promulgated on the requirements of such licensure. An\n\nauthorized provider is excluded from the population limitations of\n\nSection 1041 of this title and is required to be licensed regardless\n\nof the population of the political subdivision.\n\nC. To obtain an authorized provider inspector license, the\n\nindividual shall:\n\n1. Be recognized by a political subdivision as meeting all\n\nrequirements for a state inspector's license in the category of the\n\ninspections being performed and be free of direction and control of\n\nany contractor who is requesting the inspection;\n\n2. Pass the inspector examination approved by the Oklahoma\n\nInspector Examiners Committee and complete all other requirements in\n\nthe Oklahoma Inspectors Act and rules for each category sought; and\n\n3. Complete an authorized provider inspector license\n\napplication for the examination, license or renewal of license. The\n\napplication shall be completed in writing on forms furnished by the\n\nConstruction Industries Board. Each application shall be\n\naccompanied by a fee and proof of continuing education for renewals\n\nas required in the Oklahoma Inspectors Act and rules.\n\nD. It shall be unlawful for any person to act as or perform the\n\nwork of an authorized provider inspector unless such person is\n\nqualified and licensed pursuant to the Oklahoma Inspectors Act. An\n\nauthorized provider inspector license does not authorize an\n\nindividual to issue permits.\n\nE. Authorized provider inspectors licensed by the state are\n\ndeemed to be acting as independent contractors and not as officers,\n\nemployees or agents of the state or any political subdivision.\n\nNeither the state nor the political subdivision assumes any\n\nliability for the actions or omissions of licensed authorized\n\nproviders.\n\nF. Authorized providers shall:\n\n1. In addition to complying with the provisions of the Oklahoma\n\nInspectors Act, provide proof of insurance coverage of up to One\n\nMillion Dollars ($1,000,000.00) in professional liability insurance,\n\nin addition to One Million Dollars ($1,000,000.00) in errors and\n\nomissions insurance as set by rule. Proof of valid and current\n\ninsurance coverage must be provided upon application for\n\nregistration and renewal of registration in the form of an insurance\n\ncertificate listing the State of Oklahoma as the certificate holder.\n\nFurther, proof of compliance with the workers' compensation laws of\n\nOklahoma or exemption is required. Lapse of insurance shall result\n\nin the change of license status to inactive;\n\n2. Not be under the direction and control of any entity that\n\nperforms industrial, commercial or residential construction for\n\nwhich they would provide services;\n\n3. Not be under the direction and control of any entity that\n\ndesigns industrial, commercial or residential projects for which\n\nthey would provide services;\n\n4. Provide written reports acceptable to the political\n\nsubdivision according to the political subdivision requirements;\n\n5. Not be prohibited in the Oklahoma Inspectors Act from\n\nproviding other plan review and inspection services for\nices;\n\n3. Not be under the direction and control of any entity that\n\ndesigns industrial, commercial or residential projects for which\n\nthey would provide services;\n\n4. Provide written reports acceptable to the political\n\nsubdivision according to the political subdivision requirements;\n\n5. Not be prohibited in the Oklahoma Inspectors Act from\n\nproviding other plan review and inspection services for\n\njurisdictions that pertain to infrastructure projects, utilities\n\nprojects or other services not regulated by the Oklahoma Inspectors\n\nAct, except as restricted or limited by the political subdivision;\n\n6. Not be allowed to apply for a provisional license as\n\ndescribed in Section 1036 of this title; and\n\n7. Provide evidence of being certified for the specific license\n\ncategory for which they are applying and shall only provide services\n\nin the area of certification and licensing.\n\nG. Beginning November 1, 2019, and until administrative rules\n\nconcerning authorized provider licensure have been finally adopted\n\npursuant to the Administrative Procedures Act, authorized agent\n\nlicensure shall be equivalent to authorized provider licensure\n\npursuant to the Oklahoma Inspectors Act, and existing administrative\n\nrules set forth in the Oklahoma Administrative Code relating to\n\nauthorized agent licensure shall remain in effect.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2691e6d7c241257bf5fd0b72948a8be2653f3f887fe855a46eea11b1111cae70","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-1045","next":"us-ok/okla.-stat.-tit.-59-59-1101"},"notice":"GroundRules: Original legal text.
