As used in the Waterworks and Wastewater Works Operator\n\nCertification Act:\n\n1. \"Board\" means the Environmental Quality Board of the State\n\nof Oklahoma;\n\n2. \"Certificate\" means a certificate of competency issued as\n\nprovided for herein;\n\n3. \"Department\" means the Oklahoma Department of Environmental\n\nQuality;\n\n4. \"Executive Director\" means the Executive Director of the\n\nOklahoma Department of Environmental Quality;\n\n5. \"Helper\" means any person who performs or assists in the\n\nperformance of work which may affect the quality of either water or\n\nwastewater;\n\n6. \"Operator\" means any person who is at any time responsible\n\nfor the operation of a wastewater works or waterworks or associated\n\nlaboratories, in part or in whole. Operator shall not ordinarily\n\napply to an official exercising official general administrative\n\nsupervision but shall include any person who can, through a direct\n\nact or command, affect the quality of the water or wastewater;\n\n7. \"Person\" means and includes individuals, firms,\n\npartnerships, associations, and corporations; and also means and\n\nincludes the State of Oklahoma, counties, districts, municipalities,\n\nand all subdivisions, districts, officers, agencies, departments,\n\ninstitutions, or instrumentalities of any thereof, whether\n\ngovernmental or proprietary;\n\n8. \"Wastewater works\" means wastewater treatment systems and\n\nfacilities used in the collection, transmission, storage, pumping,\n\ntreatment or disposal of liquid or waterborne wastes, except as\n\nprovided in subsection B of this section; and\n\n9. \"Waterworks\" means facilities used in the procurement,\n\ntreatment, storage, pumping or distribution of water for human\n\nconsumption, except as provided in subsection B of this section.\n\nB. The words \"waterworks\", or \"wastewater works\" shall not\n\ninclude:\n\n1. Any waterworks used exclusively by a private residence or a\n\nprivate business or industry, except when a waterworks has fifteen\n\nor more permanent or temporary service connections available for\n\nresidential use, or regularly serves twenty-five or more of the same\n\nindividuals at least six (6) months in a year;\n\n2. Any nonindustrial wastewater works treatment system which\n\nhas an average flow of five thousand (5,000) gallons per day or\n\nless;\n\n3. Any industrial wastewater works; and\n\n4. Such classes of systems, which because of their size, type\n\nof treatment, or the nature of wastes involved, the Board shall find\n\ndo not require general supervision by a certified operator in order\n\nto safeguard life, health, property, or the water supplies or\n\nstreams of this state.
